【摘要】：中國的對外援助事業(yè)已發(fā)展60余年,取得了可喜的成績和世界贊譽(yù),但法治化進(jìn)程依舊步履維艱,中國對外援助法律規(guī)范尚停滯在部門規(guī)章的范疇,沒有更高位階的法律文件作為指導(dǎo),已在某種程度上制約中國對外援助事業(yè)的更高更遠(yuǎn)的發(fā)展。探究中國對外援助的法治化管理,找出當(dāng)前中國對外援助存在的法律缺陷和不足,對中國對外援助立法框架提出筆者的一些思考和建議,即為本文的出發(fā)點(diǎn)和落腳點(diǎn)。 本文從以上角度出發(fā),共分三個(gè)部分進(jìn)行闡述。 第一部分是關(guān)于我國對外援助的工作特點(diǎn)和管理。首先簡單介紹中國對外援助的歷史發(fā)展與現(xiàn)狀,介紹現(xiàn)行我國對外援助的主要實(shí)施主體和管理模式,概述中國對外援助的實(shí)施特點(diǎn)和實(shí)施方式,使讀者對中國對外援助工作有一個(gè)清晰的認(rèn)識和了解。并以此為依據(jù)引出本文的寫作動(dòng)機(jī)和目的。 第二部分概述中國對外援助法律體系現(xiàn)狀及缺陷,探究當(dāng)前我國對外援助工作在法律法規(guī)執(zhí)行方面存在的問題,強(qiáng)調(diào)援外法治化管理的重要意義,探索中國對外援助的法制發(fā)展方向。 第三部分是本文創(chuàng)新和立意之所在,即通過回顧中國對外援助歷程,了解中國對外援助工作的主要內(nèi)容、執(zhí)行程序,找到我國對外援助現(xiàn)有法律體系的缺陷,比較分析世界范圍內(nèi)援助立法的特點(diǎn)和形式,提出關(guān)于建立中國對外援助法律框架的初步構(gòu)想,以實(shí)現(xiàn)對外援助的法治化管理。
[Abstract]:China's foreign aid cause has been developing for more than 60 years, and it has made gratifying achievements and world acclaim, but the process of rule of law is still difficult, and the legal norms of China's foreign aid are still stagnant in the scope of departmental rules and regulations. Without a higher level of legal documents as a guide, it has to some extent restricted the higher and further development of China's foreign aid undertakings. This paper finds out the legal defects and shortcomings of China's foreign aid, and puts forward some thoughts and suggestions on the legislative framework of China's foreign aid, which is the starting point and the end of this paper. This article from above angle, altogether divides three parts carries on the elaboration. The first part is about the characteristics and management of China's foreign aid. Firstly, it briefly introduces the historical development and present situation of China's foreign aid, and introduces the main implementing body and management mode of China's foreign aid. This paper summarizes the characteristics and methods of China's foreign aid implementation, so that readers have a clear understanding of China's foreign aid work, and on this basis leads to the writing motivation and purpose of this paper. The second part summarizes the current situation and defects of China's foreign aid legal system, probes into the problems existing in the implementation of laws and regulations in the current work of foreign aid in China, and emphasizes the important significance of the legalization of foreign aid management. To explore the legal development direction of China's foreign aid. The third part is the innovation and idea of this paper, that is, by reviewing the course of China's foreign aid, we can understand the main contents of China's foreign aid work, carry out the procedure, and find out the defects of the existing legal system of China's foreign aid. This paper compares and analyzes the characteristics and forms of the worldwide aid legislation, and puts forward a preliminary conception of establishing the legal framework of China's foreign aid in order to realize the legalization of foreign aid management.
