【摘要】:經(jīng)濟(jì)全球化的迅猛發(fā)展的同時(shí),區(qū)域經(jīng)濟(jì)一體化的趨勢(shì)也愈演愈烈。在這樣的背景下,發(fā)達(dá)國(guó)家紛紛要求實(shí)現(xiàn)投資自由化,而發(fā)展中國(guó)家則出于本國(guó)的經(jīng)濟(jì)主權(quán)的考慮,在接受發(fā)達(dá)國(guó)家投資的時(shí)候設(shè)置一些管制措施。在這樣的情況下,投資國(guó)與東道國(guó)之間便在投資問(wèn)題上產(chǎn)生了矛盾。TRIMs協(xié)議作為WTO體制下的多邊投資協(xié)議在處理各國(guó)間產(chǎn)生的投資爭(zhēng)議中雖然發(fā)揮了重要作用,但是由于其適用范圍有限,各國(guó)仍然希望產(chǎn)生一項(xiàng)能夠全面運(yùn)用于投資爭(zhēng)議的法律文件。因此,在區(qū)域一體化組織的層面上,大量出現(xiàn)了一些適用于區(qū)域內(nèi)的投資協(xié)定,這些協(xié)定大大彌補(bǔ)了TRIMs協(xié)議在調(diào)整國(guó)際投資方面的不足。在中國(guó)方面,經(jīng)過(guò)了幾十年的發(fā)展,中國(guó)已經(jīng)由一個(gè)單純接受外國(guó)投資的被投資國(guó)過(guò)渡到開始向海外進(jìn)行投資的投資國(guó),因此,國(guó)內(nèi)對(duì)于投資自由化的呼聲和期望也越來(lái)越大。本文通過(guò)將RTAs投資協(xié)定的一些重點(diǎn)問(wèn)題與TRIMs協(xié)議進(jìn)行比較和分析,為我國(guó)參與制定區(qū)域投資提供參考意見。 全文分為5個(gè)部分進(jìn)行論述。第一部分對(duì)RTAs投資協(xié)定與TRIMs協(xié)議的核心概念和基本理論進(jìn)行闡述和對(duì)比。在基本理論方面,介紹了RTAs投資協(xié)定與TRIMs協(xié)議各自的發(fā)展歷程與主要內(nèi)容;另外,還對(duì)兩者的立法模式進(jìn)行了一番對(duì)比研究,從而明確了RTAs投資協(xié)定的特點(diǎn)以及對(duì)TRIMs協(xié)議的相關(guān)發(fā)展。 第二部分對(duì)兩者的原則進(jìn)行比較分析,通過(guò)比較,RTAs投資協(xié)定規(guī)定的原則相對(duì)于TRIMs協(xié)議有更大的適用范圍,也更為國(guó)際社會(huì)所推崇。這也是TRIMs協(xié)議未來(lái)發(fā)展急需改進(jìn)的一大領(lǐng)域。 第三部分選取了投資準(zhǔn)入、投資待遇以及投資保護(hù)幾項(xiàng)國(guó)際投資法律規(guī)則最為關(guān)注的內(nèi)容進(jìn)對(duì)比、研究。更加明確了國(guó)際投資自由化趨勢(shì)對(duì)RTAs投資協(xié)定和TRIMs協(xié)議未來(lái)發(fā)展的方向,這也是中國(guó)參與區(qū)域投資協(xié)議制定應(yīng)當(dāng)重點(diǎn)關(guān)注的方面,是第四部分提出中國(guó)參與制定區(qū)域投資協(xié)定建議的支撐點(diǎn)。 最后一部分是對(duì)中國(guó)參與制定區(qū)域投資協(xié)定的若干建議。分別從決策者的認(rèn)識(shí)、立足現(xiàn)有基礎(chǔ)、開拓新興投資市場(chǎng)、加強(qiáng)規(guī)則研究等幾個(gè)方面對(duì)中國(guó)參與制定區(qū)域投資協(xié)定提出建議。
[Abstract]:With the rapid development of economic globalization, the trend of regional economic integration is becoming increasingly fierce. Against this background, developed countries demand investment liberalization one after another, while developing countries consider their own economic sovereignty. Put in place controls when receiving investment from developed countries. In such cases, As a multilateral investment agreement under WTO system, trims agreement plays an important role in dealing with investment disputes between countries, but its scope of application is limited. States still want to produce a legal document that can be fully applied to investment disputes. As a result, at the level of regional integration organizations, a large number of investment agreements applicable to the region have emerged, These agreements make up for the shortcomings of the TRIMs agreement in adjusting international investment. In China, after decades of development, China has transitioned from a recipient country that simply receives foreign investment to one that has begun to invest abroad, so, By comparing and analyzing some key issues of RTAs investment agreement and TRIMs agreement, this paper provides reference for China to participate in the formulation of regional investment. The thesis is divided into five parts. The first part expounds and compares the core concepts and basic theories of RTAs investment agreement and TRIMs agreement. This paper introduces the development history and main contents of RTAs investment agreement and TRIMs agreement, and makes a comparative study on the legislative models of the two agreements, so as to clarify the characteristics of RTAs investment agreement and the related development of TRIMs agreement. The second part makes a comparative analysis of the two principles. By comparing the principles stipulated in the RTAs investment agreement, it has a wider scope of application than the TRIMs agreement. It is also an area where the TRIMs protocol needs to be improved in the future. In the third part, the contents of investment access, investment treatment and investment protection are compared. Research. The trend of international investment liberalization is more clear to the future development direction of RTAs investment agreement and TRIMs agreement, which is also the aspect that China should pay attention to in making regional investment agreement. Is the 4th part of China to participate in the formulation of regional investment agreement proposal support point. The last part is a number of suggestions on China's participation in the formulation of regional investment agreements. Strengthen the study of rules and other aspects of China's participation in the formulation of regional investment agreements.
