【摘要】:就當(dāng)前理論與實踐而言,實現(xiàn)貿(mào)易自由化的途徑主要有兩條,分別為WTO多邊貿(mào)易體制和區(qū)域貿(mào)易體制。然囿于多邊貿(mào)易體制交易成本較大等問題,近年來,區(qū)域經(jīng)濟(jì)一體化已然成為全球經(jīng)濟(jì)發(fā)展的趨勢。伴隨服務(wù)貿(mào)易在全球范圍內(nèi)不斷發(fā)展以及服務(wù)貿(mào)易多邊自由化進(jìn)程受挫,,區(qū)域性貿(mào)易協(xié)定中不斷加入服務(wù)貿(mào)易的相關(guān)內(nèi)容,推動區(qū)域服務(wù)貿(mào)易自由化得到快速發(fā)展。 作為服務(wù)貿(mào)易多邊化的重要成果,《服務(wù)貿(mào)易總協(xié)定》(GneneralAgreement on Tradein Services,以下簡稱GATS)第5條對服務(wù)貿(mào)易經(jīng)濟(jì)一體化作出規(guī)定,其內(nèi)容包括“涵蓋眾多服務(wù)部門”、“取消實質(zhì)上所有歧視”、“不得提高貿(mào)易壁壘總體水平”等實體要件以及“通知”、“定期報告”、“審查”等程序要件。這些要件不僅是關(guān)涉各區(qū)域性組織制定服務(wù)貿(mào)易規(guī)則的合法性問題,而且是各服務(wù)貿(mào)易區(qū)域經(jīng)濟(jì)一體化協(xié)議面臨的共同性問題。但是,GATS第5條本身卻存在規(guī)定不明確、概念不清晰等諸多解釋性問題。因此,本文欲從理論與實證結(jié)合的角度,綜合運(yùn)用文本分析、比較分析及法經(jīng)濟(jì)學(xué)分析,闡明GATS第5條所涉的相關(guān)法律問題,并希望為我國今后開展GATS第5條多邊談判以及參與區(qū)域服務(wù)貿(mào)易合作提供參考。 本文分為五部分: 第一部分對GATS第5條的基礎(chǔ)理論問題進(jìn)行梳理,從GATS第5條所涉“經(jīng)濟(jì)一體化”的界定入手,對服務(wù)貿(mào)易區(qū)域經(jīng)濟(jì)一體化的法律基礎(chǔ)、現(xiàn)狀及成因進(jìn)行簡要分析。 第二部分對GATS第5條的制定及其法律框架進(jìn)行深入分析。主要運(yùn)用歷史分析方法,從GATS第5條的締結(jié)及談判背景著手,試圖從根源上探尋GATS第5條涉及的基本問題,并以此為切入點(diǎn),連帶分析GATS第5條的范圍及法律框架。 第三部分著眼于對GATS第5條實體要件的文本分析,先后對“涵蓋眾多服務(wù)部門”、“取消實質(zhì)上所有歧視”、“不得提高貿(mào)易壁壘的總體水平”進(jìn)行闡釋,并結(jié)合GATT第24條進(jìn)行對比研究,立足實際,以各成員提案作為參考,論證該實體要件的科學(xué)合理之處及存在的缺陷,并且對于具體問題提出建議。 第四部分著重于對GATS第5條的程序要件進(jìn)行文本分析,“通知”、“定期報告”及“審查”均是透明度機(jī)制的具體體現(xiàn),同時結(jié)合GATS和GATT其他條文中所包含的類似用語進(jìn)行對比分析,欲從同一框架體系中探尋明確性的解釋,并在分析過程中指出程序要件的缺陷并及時提出建議。 最后,本文的第五部分在前四部門分析基礎(chǔ)之上,提出對GATS第5條的完善建議。由于GATS第5條的完善終究以談判開始、以談判結(jié)束,并且基于第三部分和第四部門在分析中就某些細(xì)節(jié)問題已提出具體建議,因此提出建議過程分別從談判角度以及框架性機(jī)制角度提出建議,試圖在宏觀上為GATS第5條的充實和完善獻(xiàn)言獻(xiàn)策。
[Abstract]:In terms of current theory and practice, there are two main ways to realize trade liberalization, namely, WTO multilateral trading system and regional trading system. However, due to the large transaction cost of multilateral trading system, in recent years, Regional economic integration has become the trend of global economic development. With the continuous development of trade in services in the global scope and the setback of multilateral liberalization of trade in services, regional trade agreements continue to incorporate the relevant contents of trade in services. Promoting the rapid development of regional service trade liberalization. As an important achievement of multilateral trade in services, Article 5 of the General Agreement on Trade in Services (GATS) provides for the economic integration of trade in services. They include substantive elements such as "cover a wide range of services sectors", "eliminate all substantive discrimination", "do not raise the overall level of barriers to trade", and procedural elements such as "Notification", "Periodic report" and "Review". These elements are not only. Dealing with the legality of rules on trade in services by regional organizations, However, Article 5 of GATS itself has many explanatory problems, such as unclear regulation, unclear concept and so on. Therefore, this paper intends to combine the theory with the empirical point of view, which is the common problem faced by the regional economic integration agreements of trade in services, however, Article 5 of GATS itself has many explanatory problems, such as unclear provisions, unclear concepts, and so on. This paper makes comprehensive use of text analysis, comparative analysis and legal and economic analysis to elucidate the relevant legal issues involved in Article 5 of GATS, and hopes to provide a reference for China to carry out multilateral negotiations on Article 5 of GATS and to participate in regional trade cooperation in services in the future. This paper is divided into five parts:. The first part combs the basic theoretical problems of Article 5 of GATS, starting with the definition of "economic integration" in Article 5 of GATS, and briefly analyzes the legal basis, present situation and causes of regional economic integration of service trade. The second part makes an in-depth analysis of the formulation and legal framework of Article 5 of GATS. By means of historical analysis, the author tries to explore the basic problems involved in Article 5 of GATS from the root of the conclusion and negotiation background of Article 5 of GATS. As a starting point, this paper analyzes the scope and legal framework of Article 5 of GATS. The third part focuses on the text analysis of the substantive elements of Article 5 of GATS, successively explains "covering many service sectors", "eliminating all discrimination in substance" and "not to raise the overall level of trade barriers". Combined with the comparative study of Article 24 of GATT, based on the practice and taking the member's proposal as the reference, this paper demonstrates the scientific and reasonable points and the defects of the substantive elements, and puts forward some suggestions for the concrete problems. Part 4th focuses on the textual analysis of the procedural elements of Article 5 of the GATS. "Notification", "Periodic report" and "Review" are all concrete manifestations of the transparency mechanism. At the same time, combining with the similar terms contained in other articles of GATS and GATT, this paper makes a comparative analysis, in order to explore the clear explanation from the same frame system, and points out the defects of procedural elements and puts forward some suggestions in the process of analysis. Finally, on the basis of the analysis of the first four departments, the 5th part of this paper puts forward some suggestions for the improvement of Article 5 of GATS. Since the perfection of Article 5 of GATS begins with negotiation, it ends with negotiation. And based on the fact that the third part and the 4th department have made specific suggestions on some detailed issues in the analysis, the process of making the recommendations is from the perspective of negotiation and framework mechanism, respectively. This paper attempts to offer suggestions for the enrichment and perfection of Article 5 of GATS on the macro level.
