【摘要】：近些年來,人類外空活動迅速發(fā)展,空間開發(fā)及應(yīng)用能力大大加強(qiáng)�？臻g開發(fā)具有自身的特殊性和難點(diǎn),其特有的高成本和風(fēng)險(xiǎn)及尖端技術(shù)的開發(fā)使得謀求在外空領(lǐng)域的國際合作成為必然。同時(shí),國際空間合作也是國際空間法律規(guī)范倡導(dǎo)的基本原則之一。區(qū)域性空間合作是國際空間合作的重要形式,也是開展和加強(qiáng)區(qū)域空間技術(shù)交流與互信的有效渠道。 亞太地區(qū)人口眾多、經(jīng)濟(jì)活躍,空間技術(shù)需求很大。此外,該地區(qū)各國空間開發(fā)能力梯度較大,互補(bǔ)性強(qiáng),這為區(qū)域性的空間合作提供了良好的基礎(chǔ)和機(jī)會。從上世紀(jì)末開始,隨著各種區(qū)域性空間合作模式的建立及運(yùn)行,亞太地區(qū)的空間合作進(jìn)入了一個(gè)新的階段。目前,該地區(qū)主要的空間合作模式主要有亞太空間合作組織、亞太空間機(jī)構(gòu)論壇及亞太地區(qū)空間教育與科技中心等。近幾年,這些合作機(jī)制發(fā)展很快,對該地區(qū)的空間合作與交流起到了很大的促進(jìn)作用。但是,隨著國際空間合作形勢的發(fā)展和亞太地區(qū)空間技術(shù)需求的不斷增大,目前的空間合作機(jī)制也出現(xiàn)了一些問題,主要表現(xiàn)在次區(qū)域性明顯,法律結(jié)構(gòu)差異較大、合作機(jī)制發(fā)展分散、尤其是整體法律模式亟待完善,這成為實(shí)務(wù)界和學(xué)界關(guān)注的重點(diǎn)。 本文采用文獻(xiàn)分析與比較分析的方法對亞太地區(qū)的空間合作模式展開分析,首先鎖定幾個(gè)典型空間合作機(jī)制,并對其進(jìn)行橫向比較,試圖以法律視角尋求進(jìn)一步深化亞太地區(qū)空間合作的必要性與可行性,重點(diǎn)研究其不同法律結(jié)構(gòu)和發(fā)展模式的空間合作形式的合作前景。文章主要將對具有獨(dú)立法律人格的亞空組織和以松散的論壇為主要形式的亞太空間機(jī)構(gòu)論壇展開分析,從發(fā)展歷程、法律結(jié)構(gòu)、整體模式等角度探討二者合作的現(xiàn)實(shí)必然性。本文的研究,可以在新形勢下對亞太地區(qū)的空間合作模式進(jìn)行分析并提出完善建議,有利于該區(qū)域在空間開發(fā)及應(yīng)用上的多邊合作進(jìn)一步展開和深化,為該區(qū)域的空間合作持續(xù)發(fā)展探索一條可行途徑。
[Abstract]:In recent years, human outer space activities have developed rapidly and the ability of space development and applications has been greatly strengthened. Space development has its own particularities and difficulties. Its unique high costs and risks and the development of cutting-edge technologies necessitate the pursuit of international cooperation in the field of outer space... at the same time, Regional space cooperation is an important form of international space cooperation and an effective channel for developing and strengthening regional space technology exchanges and mutual trust. The Asia-Pacific region has a large population, a vibrant economy and a large demand for space technology. In addition, the space development capabilities of the countries in the region have a large gradient and are highly complementary. This provides a good basis and opportunity for regional space cooperation. Since the end of 0th century, with the establishment and operation of various regional space cooperation models, space cooperation in the Asia-Pacific region has entered a new stage. The main modes of space cooperation in the region include the Asia-Pacific Space Cooperation Organization, the Asia-Pacific Space Agency Forum and the Asia-Pacific Center for Space Education and Science and Technology. In recent years, these cooperation mechanisms have developed rapidly. However, with the development of international space cooperation and the increasing demand for space technology in the Asia-Pacific region, there are also some problems in the current space cooperation mechanism. It is mainly manifested in the sub-regional obvious, the legal structure difference is big, the cooperation mechanism development is dispersed, especially the whole legal model needs to be perfected, which becomes the focus of the practical and academic circles. This paper uses the methods of literature analysis and comparative analysis to analyze the space cooperation modes in the Asia-Pacific region. Firstly, several typical space cooperation mechanisms are locked in and compared horizontally. This paper attempts to seek the necessity and feasibility of further deepening space cooperation in the Asia-Pacific region from a legal perspective. Focusing on the prospects for cooperation in space cooperation in its different legal structures and development models. The article will focus on the analysis of subspace organizations with independent legal personality and the Asia-Pacific Space Agency Forum, mainly in the form of a loose forum, This paper discusses the realistic inevitability of the cooperation between the two from the perspectives of development, legal structure and overall model. The research in this paper can analyze the space cooperation mode in the Asia-Pacific region under the new situation and put forward some suggestions to perfect it. It is beneficial for the multilateral cooperation in space development and application in the region to further develop and deepen, and to explore a feasible way for the sustainable development of space cooperation in the region.
