【摘要】：隨著世界經(jīng)濟(jì)聯(lián)系越來(lái)越緊密,中國(guó)的國(guó)際貿(mào)易市場(chǎng)進(jìn)一步拓寬和發(fā)展,歐盟對(duì)于我國(guó)對(duì)外貿(mào)易合作具有越來(lái)越重要的戰(zhàn)略地位,同時(shí)伴隨著貿(mào)易的不斷深入和拓展,各種貿(mào)易救濟(jì)措施也層出不窮,而反規(guī)避措施則作為反傾銷措施的補(bǔ)充與發(fā)展,在貿(mào)易保護(hù)措施方面已經(jīng)越來(lái)越被廣泛地使用。據(jù)相關(guān)數(shù)據(jù)統(tǒng)計(jì),我國(guó)已經(jīng)在近二十年內(nèi)年已經(jīng)成為遭受反傾銷措施最多的國(guó)家,也是遭受反規(guī)避最嚴(yán)重的國(guó)家,而其中關(guān)于規(guī)避行為認(rèn)定是該制度中最重要的規(guī)則。在遭受反規(guī)避調(diào)查的案件之中,其中很大一部分是來(lái)源于歐盟的調(diào)查,勢(shì)必給我國(guó)的對(duì)外貿(mào)易產(chǎn)生重大不利影響。故此,為讓企業(yè)從容地應(yīng)對(duì)歐盟的反傾銷之反規(guī)避調(diào)查,為進(jìn)一步保障我國(guó)對(duì)外貿(mào)易中的正當(dāng)利益,我們有必要對(duì)歐盟反規(guī)避制度中規(guī)避行為認(rèn)定規(guī)則的現(xiàn)狀以及實(shí)踐進(jìn)行全面而深入的研究。本文僅僅局限于對(duì)歐盟之反規(guī)避制度之規(guī)避行為認(rèn)定規(guī)則的法律研究,開(kāi)篇主要介紹了規(guī)避與反規(guī)避的性質(zhì)以及對(duì)反規(guī)避措施的合法合理性討論,同時(shí)對(duì)歐盟反規(guī)避制度的立法沿革進(jìn)行了闡述。其后在對(duì)歐盟反規(guī)避立法的介紹下,通過(guò)案例的方式對(duì)歐盟的具體規(guī)避行為認(rèn)定的實(shí)體規(guī)則進(jìn)行分析和討論。本文著重點(diǎn)在于對(duì)歐盟的規(guī)避行為認(rèn)定實(shí)體規(guī)則、豁免制度、與規(guī)避行為認(rèn)定相關(guān)的原產(chǎn)地規(guī)則通過(guò)案例方式進(jìn)行分析論證,并結(jié)合學(xué)界以及實(shí)務(wù)界對(duì)此的觀點(diǎn),全面分析歐盟的規(guī)避行為認(rèn)定規(guī)則,通過(guò)對(duì)此規(guī)則的優(yōu)缺點(diǎn)探討后,結(jié)合我國(guó)情況向企業(yè)和政府提供有針對(duì)性的建議。
[Abstract]:With the closer and closer economic ties in the world and the further expansion and development of China's international trade market, the EU has a more and more important strategic position for China's foreign trade cooperation. At the same time, with the continuous deepening and expanding of trade, Various trade relief measures have emerged in endlessly. Anti-circumvention measures, as a supplement and development of anti-dumping measures, have been more and more widely used in trade protection measures. According to relevant statistics, In the past 20 years, China has become the country that has suffered the most anti-dumping measures, and has also suffered the most serious anti-circumvention. Among them, the identification of circumvention is the most important rule in this system. In the cases under anti-circumvention investigation, a large part of which comes from the investigation of the European Union, which is bound to have a significant adverse impact on our foreign trade. In order to allow enterprises to respond calmly to EU anti-dumping anti-circumvention investigations, and to further safeguard the legitimate interests of China's foreign trade, It is necessary for us to conduct a comprehensive and in-depth study on the current situation and practice of the rules for the identification of circumvention in the anti-circumvention system of the European Union. In the beginning, the author mainly introduces the nature of circumvention and anti-circumvention, discusses the legal rationality of anti-circumvention measures, and expounds the legislative evolution of EU anti-circumvention system. This paper analyzes and discusses the substantive rules for the confirmation of specific circumvention behavior in the European Union through case studies. This paper focuses on the substantive rules of the confirmation of circumvention in the EU, the exemption system, The rules of origin related to the identification of circumvention are analyzed through case studies, and combined with the views of academic and practical circles, the rules of identification of circumvention in the European Union are comprehensively analyzed, and the advantages and disadvantages of this rule are discussed. Combined with the situation of our country to provide targeted advice to enterprises and governments.
