【摘要】：信用證作為一種廣泛采用的國(guó)際結(jié)算工具,在國(guó)際貿(mào)易中起著重要的作用。其隨著最新的UCP600的頒布又有了許多新的發(fā)展。筆者認(rèn)為其中最突出的發(fā)展是信用證審單制度的變化,信用證審單是信用證交易的中心環(huán)節(jié),這些變化對(duì)信用證相關(guān)當(dāng)事方的權(quán)利、義務(wù)及責(zé)任重新進(jìn)行了分配,對(duì)整個(gè)信用證法律制度產(chǎn)生了重大的影響。本文在對(duì)信用證審單的法律內(nèi)涵進(jìn)行重新審視的基礎(chǔ)之上,對(duì)UCP600與UCP500中信用證審單相關(guān)條文進(jìn)行比較分析,同時(shí)結(jié)合新的已在UCP600中作為信用證審單必須參照的國(guó)際標(biāo)準(zhǔn)銀行實(shí)務(wù)(ISBP681)的規(guī)定,對(duì)新的信用證審單標(biāo)準(zhǔn)進(jìn)行分析研究。文章系統(tǒng)地闡述了合格的審單主體所應(yīng)采用的審單原則,通過(guò)對(duì)比各種審單原則,研究了審單領(lǐng)域的難點(diǎn)一一單單一致、單證一致問(wèn)題。并且以單據(jù)不符點(diǎn)為切入對(duì)嚴(yán)格相符原則在實(shí)務(wù)中的理解和運(yùn)用做了適當(dāng)?shù)难芯?提出指導(dǎo)我國(guó)國(guó)際貿(mào)易中信用證審單及司法實(shí)踐審單標(biāo)準(zhǔn)認(rèn)定的意見；同時(shí),運(yùn)用法律解釋和比較的研究方法,結(jié)合最新的ISBP、國(guó)內(nèi)法、相關(guān)判例,對(duì)適用UCP600信用證單據(jù)審核實(shí)踐領(lǐng)域的相關(guān)法律問(wèn)題進(jìn)行闡述,從中探討其對(duì)信用證制度發(fā)展的最終影響,在此基礎(chǔ)上構(gòu)想我國(guó)如何依據(jù)UCP600完善我國(guó)信用證法律制度。
[Abstract]:As a widely used international settlement tool, L / C plays an important role in international trade. With the promulgation of the latest UCP600, there have been many new developments. The author thinks that the most outstanding development is the change of L / C system. The document of credit is the central link of the letter of credit transaction. These changes have redistributed the rights, obligations and responsibilities of the parties concerned in the letter of credit. On the basis of re-examining the legal connotation of L / C, this paper makes a comparative analysis of the relevant provisions of L / C in UCP600 and UCP500. At the same time, according to the stipulation of the new international standard bank practice, ISBP681, which has been used as a reference in the UCP600, this paper makes an analysis and research on the new standard of documentary examination of letters of credit. The paper systematically expounds the principle of the examination of documents which should be adopted by qualified examiners. By comparing various principles of document review, the paper studies the difficulties in the field of examining documents, namely, the problem of single consistency and consistency of documents, and makes an appropriate study on the understanding and application of the principle of strict conformity in practice, taking the discrepancy of documents as the starting point. At the same time, by using the method of legal interpretation and comparison, combining with the latest ISBPs, domestic law, relevant cases, the author puts forward some suggestions to guide the confirmation of the standard of documentary credit and judicial practice in international trade of our country, at the same time, using the method of legal interpretation and comparison, This paper expounds the relevant legal problems in the practical field of document audit of UCP600 letter of credit, discusses its final influence on the development of credit system, and on this basis conceive how to perfect the legal system of letter of credit in our country according to UCP600.
