【摘要】：中國對于自身的互聯(lián)網(wǎng)管理有著一系列的管制措施。近年來,部分西方國家不時炒作中國的互聯(lián)網(wǎng)管制措施對全球貿(mào)易產(chǎn)生不良影響,威脅將中國的網(wǎng)絡管制措施視作貿(mào)易壁壘,并打算在世界貿(mào)易組織(WTO)的機制內對中國提起訴訟。但這只是一面之詞,判斷中國的網(wǎng)絡管制措施是否構成貿(mào)易壁壘,還是必須根據(jù)現(xiàn)有的WTO規(guī)則,從中國具體的網(wǎng)絡管制措施與入世承諾出發(fā)進行探討。本文首先對于網(wǎng)絡管制措施與貿(mào)易壁壘進行粗略的介紹,之后依據(jù)WTO內貨物貿(mào)易協(xié)定(GATT)與服務貿(mào)易協(xié)定(GATS)的內容,分析其是否適用于中國的網(wǎng)絡管制措施。在得到肯定的答案后,本文分別從GATT與GATS這兩方面的角度深入分析中國的網(wǎng)絡管制措施是否構成貿(mào)易壁壘。在GATS這一方向上,本文分析了GATS內的具體規(guī)定、中國的入世承諾表中的相應內容,認為中國根本就未在網(wǎng)絡服務上做出承諾,并就市場準入、國民待遇、透明度與例外條款進行了詳細論證。在GATT這一方向上,本文同樣分析了GATT內的具體規(guī)則,就市場準入、取消數(shù)量限制與例外條款進行了詳細論證。最后本文做出結論,盡管中國在網(wǎng)絡管制措施的透明度上稍有欠缺,然而并不違反WTO之下的貿(mào)易規(guī)則,中國的網(wǎng)絡管制措施并不構成非法的貿(mào)易壁壘。
[Abstract]:China has a series of regulations on its own Internet management. In recent years, some western countries have frequently hyped China's Internet control measures to have a negative impact on global trade. Threatening to regard China's cybercontrol measures as trade barriers and intending to sue China within the World Trade Organization's WTO regime. But this is a one-sided statement to determine whether China's cybercontrol measures constitute a trade barrier. It is necessary to discuss the specific network control measures and WTO commitments according to the existing WTO rules. Firstly, this paper gives a rough introduction to the network control measures and trade barriers. Then, according to the contents of GATT and GATS within WTO, this paper analyzes whether they are applicable to China's network control measures. This paper analyzes whether China's network control measures constitute trade barriers from the angles of GATT and GATS. In the direction of GATS, this paper analyzes the specific provisions in GATS and the corresponding contents of China's WTO commitments. It is believed that China has not made any commitment to network services at all, and has made a detailed argument on market access, national treatment, transparency and exception clauses. In the direction of GATT, this paper also analyzes the specific rules in the GATT, and discusses the market access. In the end, this paper concludes that although China has a slight lack of transparency in network control measures, it does not violate the trade rules under the WTO. China's cyber controls do not constitute illegal barriers to trade.
