【摘要】：以虛擬性、開放性、用戶傳統(tǒng)自治為主要特征的全球互聯(lián)網(wǎng)的迅猛發(fā)展一方面給人類社會(huì)帶來了諸多便利,但同時(shí)也造成了諸多全球性問題。國際社會(huì)普遍呼吁就國際網(wǎng)絡(luò)予以治理。然而現(xiàn)實(shí)表明,在國際社會(huì)就網(wǎng)絡(luò)空間的法律地位形成共識(shí)以前,全球網(wǎng)絡(luò)合作很難向前推進(jìn)。在有關(guān)網(wǎng)絡(luò)空間法律地位的學(xué)說中,無論是網(wǎng)絡(luò)空間自主權(quán)說、還是網(wǎng)絡(luò)空間全球公域說都不符合網(wǎng)絡(luò)空間的技術(shù)和社會(huì)特征。網(wǎng)絡(luò)作為一國領(lǐng)土的延伸,應(yīng)該屬于一國主權(quán)范圍。在此基礎(chǔ)上,多邊治理應(yīng)該是未來網(wǎng)絡(luò)空間治理的最佳選擇。網(wǎng)絡(luò)空間治理應(yīng)尊重網(wǎng)絡(luò)發(fā)展的現(xiàn)實(shí),以全球化為網(wǎng)絡(luò)治理機(jī)制建構(gòu)的宏觀背景,采取漸進(jìn)式國際合作推進(jìn)全球網(wǎng)絡(luò)治理合作。
[Abstract]:The rapid development of the global Internet, characterized by its virtuality, openness and traditional user autonomy, has brought many conveniences to human society on the one hand. But at the same time, it has caused many global problems. The international community has generally called for the international network to be governed. However, reality shows that before the international community reaches a consensus on the legal status of cyberspace, Global cybercooperation is difficult to move forward. In the doctrine about the legal status of cyberspace, whether cyberspace autonomy, Or cyberspace, the theory of the global Commons does not conform to the technical and social characteristics of cyberspace. As an extension of the territory of a country, the network should fall within the sovereignty of a State. On this basis, Multilateral governance should be the best choice for future cyberspace governance, and cyberspace governance should respect the reality of network development, take globalization as the macro background of the construction of network governance mechanism, and adopt progressive international cooperation to promote global cybergovernance cooperation.
