【摘要】：伴隨著2008年以來(lái)幾個(gè)重大而積極的事件,兩岸關(guān)系進(jìn)入了一個(gè)新的歷史時(shí)期,加強(qiáng)海峽兩岸在各個(gè)領(lǐng)域的交流與合作,已經(jīng)成為兩岸各界民眾的迫切要求。與之而來(lái)的是兩岸民商事交往的增加,各類(lèi)糾紛紛至沓來(lái),兩岸互相的一系列司法協(xié)助問(wèn)題凸顯出來(lái)。但由于兩岸歷史、政治的原因,法律體系和制度設(shè)計(jì)的原因,兩岸區(qū)際司法協(xié)助工作仍處于“單向、間接、民間”的層面,這種現(xiàn)狀遠(yuǎn)遠(yuǎn)不能適應(yīng)兩岸的現(xiàn)實(shí)需要,甚至對(duì)兩岸的正常交往造成阻礙,從而嚴(yán)重影響了兩岸人民合法民事權(quán)益的保護(hù)、兩岸正常的經(jīng)貿(mào)往來(lái)和兩岸長(zhǎng)遠(yuǎn)的發(fā)展和統(tǒng)一。目前,兩岸司法互助的渠道還不是十分暢通,在涉及兩岸的民商事審判中存在著送達(dá)難、調(diào)查取證難、執(zhí)行難等問(wèn)題,平行訴訟、重復(fù)訴訟等區(qū)際法律沖突問(wèn)題也較為突出,迫切需要兩岸法律界通過(guò)深入的交流探討予以解決。本文擬針對(duì)這些問(wèn)題,分析我國(guó)海峽兩岸區(qū)際司法協(xié)助的現(xiàn)狀和特征,從國(guó)際上成熟的實(shí)踐經(jīng)驗(yàn)出發(fā)探討借鑒,尋求我國(guó)海峽兩岸區(qū)際司法協(xié)助的選擇模式,以期拋磚引玉,為完善相關(guān)司法實(shí)踐中遇到的迫切問(wèn)題盡綿薄之力。
[Abstract]:With several major and positive events since 2008, cross-strait relations have entered a new historical period, strengthening cross-strait exchanges and cooperation in various fields. It has become an urgent demand of the people of all walks of life on both sides of the strait. With the increase of civil and commercial exchanges between the two sides of the strait, disputes of all kinds have poured in, and a series of mutual legal assistance issues between the two sides have been highlighted. However, due to the historical and political reasons of the two sides of the strait, The reason for the design of the legal system and system is that the work of judicial assistance between the two sides of the Taiwan Strait is still on the "one-way, indirect and folk" level. This situation is far from being able to meet the actual needs of the two sides of the strait, and even hinders the normal exchanges between the two sides of the strait. This has seriously affected the protection of the legitimate civil rights and interests of the people on both sides of the strait, the normal cross-strait economic and trade exchanges, and the long-term development and reunification of the two sides. At present, the channels for mutual legal assistance between the two sides of the strait are not very smooth. In civil and commercial trials involving both sides of the Taiwan Strait, there are problems such as difficulty in service, difficulty in obtaining evidence for investigation, difficulty in execution, parallel litigation, repeated litigation, and other interregional conflicts of laws. There is an urgent need for the legal circles on both sides of the Taiwan Strait to be solved through in-depth exchanges and discussions. This paper intends to analyze the current situation and characteristics of judicial assistance between the two sides of the Taiwan Strait in view of these problems, and to explore and draw lessons from the mature practical experience of the international community. This paper seeks the choice mode of the judicial assistance between the two sides of the Taiwan Strait in order to offer a valuable reference and contribute to the perfection of the urgent problems encountered in the relevant judicial practice.
