【摘要】：2008年的奧運會上證明我國已然是一個體育大國，在興奮劑問題上，我國向來也是嚴(yán)厲打擊，力求割掉這顆“毒瘤”。嚴(yán)格責(zé)任原則使得很多案件中的運動員遭遇不合理的處罰，尤其是因服用治療所必須的藥物產(chǎn)生的問題。因此在嚴(yán)厲的背后，如何把握打擊力度是現(xiàn)今世界反興奮劑機制力求解決的問題。 治療用藥豁免（TUE即Therapeutic Use Exemption）原則屬于世界反興奮劑機制下的五項國際標(biāo)準(zhǔn)之一。TUE的申請涉及到，當(dāng)運動員因服用治療性藥物導(dǎo)致興奮劑檢測結(jié)果呈陽性時，是否能夠免除處罰的問題。該原則的產(chǎn)生源于實踐案例：人們意識到，只要存在違禁物質(zhì)就處罰運動員是苛刻的，某些疾病的用藥必然導(dǎo)致興奮劑物質(zhì)存于運動員體內(nèi)，但并不利于運動員賽事能力。因此，，TUE規(guī)則應(yīng)運而生。但是該項規(guī)則亦存在很多不可調(diào)和的矛盾和問題，筆者于是對這些問題進行探索和討論，希望能對反興奮劑工作作出自己的貢獻。 文章首先對治療用藥豁免（TUE）規(guī)則進行了概括和界定；接著通過三個案例引出了TUE規(guī)則，案例的選擇依據(jù)即TUE規(guī)則的產(chǎn)生（首例涉及用藥豁免的案件）與發(fā)展（適用規(guī)則欲推翻興奮劑處罰成功以及失敗的兩個例子），使讀者從實例中加深對規(guī)則的認(rèn)識；再次，細分TUE規(guī)則中的具體內(nèi)容，就此涉及到的主要方面展開分析，探究其理論依據(jù)和根基；最后從國際和國內(nèi)兩個方面總結(jié)個案對該原則的適用以及適用的結(jié)果，通過案例統(tǒng)計、綜述等方式進行分析，將散見于各章的針對TUE實施中出現(xiàn)的問題作總結(jié)并提出自己的補充設(shè)想。 本論文旨在通過分析和介紹反興奮劑制度中的治療用藥豁免（TUE）原則來探討反興奮劑制度的完善，同時比較我國在相關(guān)制度中的規(guī)定，以求跟上世界反興奮劑制度的步伐。
[Abstract]:In 2008, the Olympic Games proved that China is already a big sports country. On the issue of doping, our country has always been hard at cracking down on this "cancer tumor." the principle of strict liability has led to unreasonable punishment for athletes in many cases. Especially because of the problems caused by taking the drugs necessary for treatment. Therefore, how to grasp the severity of the crackdown is the problem that the world anti-doping mechanism is trying to solve. The application of the Therapeutic Use exclusion principle, one of the five international standards under the World Anti-Doping Mechanism, relates to athletes taking therapeutic drugs that result in positive stimulant testing. Whether or not punishment can be dispensed with. The principle arises from practical cases: people realize that it is harsh to punish athletes as long as there are prohibited substances, and that the use of drugs for certain diseases necessarily leads to the presence of stimulant substances in athletes. But it is not conducive to the athlete's ability to compete. Therefore, the TUE rule emerges as the times require. However, there are many irreconcilable contradictions and problems in this rule, so the author explores and discusses these problems. We hope to make our own contribution to the anti-doping work. The article firstly generalizes and defines the rule of exemption from drug use for treatment, and then leads to the rule of TUE through three cases. The selection of cases is based on the emergence of the TUE rules (the first case involving drug exemption) and development (the application of the rules to overturn the success and failure of doping penalties), which enables readers to deepen their understanding of the rules from the examples. Subdivide the specific content of TUE rules, analyze the main aspects involved, explore its theoretical basis and foundation; finally, summarize the application of the principle and its application results from the international and domestic aspects, through case statistics, This paper summarizes the problems existing in the implementation of TUE and puts forward its own supplementary ideas. The purpose of this paper is to discuss the perfection of the anti-doping system by analyzing and introducing the principle of anti-doping exemption in the anti-doping system, and to compare the relevant regulations of our country in order to keep up with the pace of the world anti-doping system.
