【摘要】：在國(guó)際貿(mào)易結(jié)算中，信用證一直扮演著重要的角色。但是近年來(lái)伴隨著國(guó)際貿(mào)易的進(jìn)一步深入，，各國(guó)廠(chǎng)商對(duì)于交易的速度以及資金融通提出了更高的要求。傳統(tǒng)的信用證已漸感力不從心，非信用證交易的產(chǎn)生正是適應(yīng)這一趨勢(shì)，國(guó)際保理就是其中的一種。國(guó)際保理在結(jié)算及融資方面有著其自身優(yōu)勢(shì)，在歐美市場(chǎng)交易結(jié)算中保理已經(jīng)占了大半壁江山，但是在我國(guó)的發(fā)展卻十分緩慢。筆者擬通過(guò)對(duì)于國(guó)際保理及其核心問(wèn)題的闡釋與分析，對(duì)我國(guó)的國(guó)際保理業(yè)務(wù)改善進(jìn)行建議。 文章第一章主要介紹國(guó)際保理的性質(zhì)、特點(diǎn)、歷史淵源，內(nèi)部對(duì)自身運(yùn)作流程進(jìn)行闡述，外部與其他結(jié)算方式比較分析。 文章第二章和第三章對(duì)國(guó)際保理中的核心問(wèn)題進(jìn)行闡述，并且用比較的方法系統(tǒng)地分析了當(dāng)前保理業(yè)務(wù)先進(jìn)的西方各國(guó)以及國(guó)際條約的立法規(guī)定，并且從中提出了自己關(guān)于保理核心問(wèn)題的見(jiàn)解。 文章的第四章闡述了目前我國(guó)保理立法方面的不足，并且結(jié)合前一章的研究成果進(jìn)行立法建議。
[Abstract]:In international trade settlement, letters of credit have always played an important role. But in recent years, with the further development of international trade, Manufacturers all over the world have put forward higher requirements for the speed of transactions and the financing of funds. Traditional letters of credit have become more and more difficult to do, and the emergence of non-letter of credit transactions has adapted to this trend. International factoring is one of them. International factoring has its own advantages in settlement and financing, and factoring has already accounted for most of the transactions in the European and American markets. However, the development of international factoring is very slow in our country. The author intends to make some suggestions on the improvement of international factoring business through the explanation and analysis of international factoring and its core problems. The first chapter mainly introduces the nature, characteristics, historical origin of international factoring, its internal operation process, external and other settlement methods comparative analysis. In the second and third chapters, the core problems of international factoring are expounded, and the legislative provisions of the western countries and international treaties are systematically analyzed by comparative methods. And put forward their own views on the core issue of factoring. Chapter 4th expounds the deficiency of factoring legislation in our country at present, and proposes the legislation according to the research results of the previous chapter.
