【摘要】：海洋法權是國際海洋法主體在其主權范圍內(nèi)及國際公共海域依據(jù)國內(nèi)立法、國際公約或國際慣例,享有的開發(fā)利用海洋的權利并承擔保護海洋和尊重他國權益的義務。海洋法權論以構建和平與安全、自由與公平、符合全人類共同利益的國際海洋秩序為宗旨,是規(guī)范各國海洋權利和權力,調(diào)整各國海洋利益沖突,協(xié)調(diào)各國海洋利益需求,平衡國家之間海洋權力與權利關系的理論。我國應在總結海洋法權實踐經(jīng)驗的基礎上,構建現(xiàn)代海洋法權理論體系。以海洋法權理論為前提優(yōu)化海洋爭議處理模式、以海洋法權理論為基礎完善中國海洋立法、以海洋法權理論為導向發(fā)揮軟法作用、以海洋法權為紐帶取得國際組織支持、以海洋法權理論為框架參與國際海洋法律制度創(chuàng)建,在國際海洋法律秩序構建中樹立話語權和主導權。
[Abstract]:The right to the law of the sea is the subject of the international law of the sea within the scope of its sovereignty and the international public sea area in accordance with domestic legislation, international conventions or international practice, The right of the law of the sea to establish an international maritime order that is peaceful and secure, free and fair and in the common interest of all mankind, It is a theory to regulate the marine rights and powers of various countries, to adjust the conflicts of national maritime interests, to coordinate the needs of the marine interests of various countries, and to balance the relationship between the maritime rights and the rights of the States. China should sum up the practical experience of the law of the sea right. Based on the theory of the right of the law of the sea to perfect China's maritime legislation, to take the law of the sea right theory as the guide to play the role of soft law, to optimize the law of the sea right theory as the premise to optimize the mode of dealing with marine disputes. Taking the right of the law of the sea as the link to obtain the support of the international organizations, taking the theory of the law of the sea as the framework to participate in the establishment of the international legal system of the sea, and to establish the right to speak and lead in the construction of the international legal order of the sea.
