【摘要】：普遍民事管轄源于美國(guó)1789年《外國(guó)人侵權(quán)索賠法案》。自美國(guó)聯(lián)邦法院1980年首次適用該法案以來,普遍民事管轄的理論與實(shí)踐引起了國(guó)際社會(huì)的廣泛關(guān)注,已發(fā)展成為與普遍刑事管轄并列的一個(gè)新領(lǐng)域。普遍民事管轄的發(fā)展給傳統(tǒng)國(guó)際法規(guī)則特別是與豁免有關(guān)的規(guī)則帶來了重大挑戰(zhàn),也給大陸法系國(guó)家?guī)砹朔芍贫葎?chuàng)新上的挑戰(zhàn)。中國(guó)有必要在本國(guó)法律制度中確立普遍民事管轄的相關(guān)制度,并在普遍管轄議題的全球性磋商中持更具建設(shè)性的立場(chǎng)。
[Abstract]:Universal civil jurisdiction originates from the Aliens Tort claims Act of 1789 in the United States. Since the Federal Court of the United States applied the Act for the first time in 1980, the theory and practice of universal civil jurisdiction have aroused widespread concern in the international community. The development of universal civil jurisdiction poses major challenges to the rules of traditional international law, in particular those relating to immunity, It is necessary for China to establish the relevant system of universal civil jurisdiction in its own legal system and to hold a more constructive position in the global consultation on the subject of universal jurisdiction.
