【摘要】：北極的法律問題現(xiàn)已經(jīng)成為國際社會對北極地區(qū)戰(zhàn)略部署和關注的重要焦點之一。在此背景下,以海洋法視角關注北極地區(qū)法律問題成為可能,但首先亟須解決適用海洋法的基礎性法律問題,即北極地區(qū)法律體系是否適用海洋法基本原則的合理性思考。本文在闡述海洋法基本原則的基礎上,分析了北極法律體系對便利國際交通原則、公平利用海洋資源原則以及海洋環(huán)境保護與可持續(xù)發(fā)展原則三大海洋法基本原則的適用可行性,從而為從海洋法視角下解決北極的海洋法問題提供了基礎性的理論依據(jù)。
[Abstract]:The legal issues of the Arctic have now become one of the important focal points of the international community's strategic deployment and attention to the Arctic region. In this context, it is possible to pay close attention to the legal issues of the Arctic region from the perspective of the law of the sea. But first of all, it is necessary to solve the basic legal problems of the application of the law of the sea, that is, whether the basic principles of the law of the sea are applicable to the legal system of the Arctic region. The feasibility of the Arctic legal system for the application of the three fundamental principles of the law of the sea, namely, the facilitation of international traffic, the equitable utilization of marine resources and the principles of the protection of the marine environment and the sustainable development of the marine environment, is analyzed. Therefore, it provides a basic theoretical basis for solving the law of the sea problem in the Arctic from the perspective of the law of the sea.
