【摘要】：專屬經(jīng)濟(jì)區(qū)是沿海國(guó)享有捕魚、開采油氣礦產(chǎn)資源等排他性經(jīng)濟(jì)權(quán)利的海域,由于寬達(dá)200海里,故在實(shí)踐中海上相鄰或相向國(guó)家的專屬經(jīng)濟(jì)區(qū)難免出現(xiàn)重疊。1982年《聯(lián)合國(guó)國(guó)際海洋法公約》對(duì)專屬經(jīng)濟(jì)區(qū)劃界方法并未作出明確規(guī)定,因此歷史上先后誕生了等距離規(guī)則和公平原則。本文將重點(diǎn)討論專屬經(jīng)濟(jì)區(qū)劃界等距離規(guī)則和公平原則的來源、概念與意義,同時(shí)對(duì)我國(guó)專屬經(jīng)濟(jì)區(qū)面臨的形勢(shì)提出了相應(yīng)對(duì)策。 本文共分為五個(gè)部分: 導(dǎo)言部分介紹了專屬經(jīng)濟(jì)區(qū)及其劃界爭(zhēng)端的歷史背景,對(duì)專屬經(jīng)濟(jì)區(qū)劃界爭(zhēng)議的根源進(jìn)行了分析。第一章專屬經(jīng)濟(jì)區(qū)及其劃界,主要對(duì)專屬經(jīng)濟(jì)區(qū)制度進(jìn)行了簡(jiǎn)要概括,并闡述了國(guó)際社會(huì)在專屬經(jīng)濟(jì)區(qū)劃界問題上的爭(zhēng)議以及兩大劃界方法。第二章等距離規(guī)則,首先追溯了等距離規(guī)則的源頭——領(lǐng)海劃界及其在大陸架和專屬經(jīng)濟(jì)區(qū)中的運(yùn)用,明確了專屬經(jīng)濟(jì)區(qū)劃界的等距離規(guī)則的概念,分析了等距離規(guī)則的意義。第三章公平原則,首先追溯了公平原則的源頭——大陸架劃界,介紹了其在專屬經(jīng)濟(jì)區(qū)劃界中的運(yùn)用,并論述了公平原則與等距離規(guī)則不斷融合的發(fā)展歷程。之后明確了公平原則的概念,分析了公平原則的意義。第四章我國(guó)專屬經(jīng)濟(jì)區(qū)劃界立法與實(shí)踐,從分析我國(guó)專屬經(jīng)濟(jì)區(qū)當(dāng)前面臨的形勢(shì)入手,為我國(guó)在黃海、東海與南海專屬經(jīng)濟(jì)區(qū)劃界提出具體對(duì)策,以充分維護(hù)我國(guó)合法權(quán)益。
[Abstract]:The exclusive economic zone is the sea area in which coastal States enjoy exclusive economic rights such as fishing, oil, gas and mineral resources. Therefore, in practice, overlaps inevitably occur in the exclusive economic zones of countries adjacent to or facing each other at sea. In 1982, the United Nations Convention on the Law of the Sea did not clearly specify the method of delimitation of exclusive economic zones. This paper will focus on the origin, concept and significance of the isometric rule and the principle of equity in the delimitation of the exclusive economic zone. At the same time, put forward the corresponding countermeasure to the situation that our country exclusive economic zone faces. This paper is divided into five parts:. The introduction part introduces the historical background of the exclusive economic zone and its delimitation dispute, and analyzes the origin of the exclusive economic zone delimitation dispute. Chapter 1, the exclusive economic zone and its delimitation, mainly summarizes the system of the exclusive economic zone. In chapter two, the isometric rule, the origin of the isometric rule and its application in the continental shelf and exclusive economic zone, is first traced back to the source of the isometric rule, which is the delimitation of the territorial sea and its application in the continental shelf and the exclusive economic zone. This paper clarifies the concept of the equal distance rule for the delimitation of the exclusive economic zone, and analyzes the significance of the equal distance rule. Chapter III, the principle of equity, first traces the origin of the principle of equity-the delimitation of the continental shelf, and introduces its application in the delimitation of the exclusive economic zone. It also discusses the development of the integration of the principle of equity and the rule of equal distance, and then clarifies the concept of the principle of equity, analyzes the significance of the principle of fairness. Chapter 4th, legislation and practice of delimitation of China's exclusive economic zone. Based on the analysis of the current situation of China's exclusive economic zone, this paper puts forward concrete countermeasures for the delimitation of China's exclusive economic zone in Huang Hai, the East China Sea and the South China Sea, in order to fully safeguard the legitimate rights and interests of our country.
