【摘要】：伴隨著中美兩國貿(mào)易的加速發(fā)展,知識(shí)產(chǎn)權(quán)領(lǐng)域的摩擦也成為了兩國的爭(zhēng)論焦點(diǎn),在很大程度上阻礙了兩國貿(mào)易的發(fā)展。近來年美國主要根據(jù)"337條款"對(duì)中國出口美國的產(chǎn)品進(jìn)行調(diào)查。本文介紹了摩擦的歷史過程及"337調(diào)查"的基本情況,發(fā)現(xiàn)近年來"337調(diào)查"數(shù)量較多且涉案產(chǎn)品類型越來越廣,并且摩擦的發(fā)生主要是因?yàn)橹贫炔町悺①Q(mào)易不平衡及保護(hù)意識(shí)的淡薄等。因此,中國政府和企業(yè)都要采取合適的策略來減少知識(shí)產(chǎn)權(quán)摩擦。
[Abstract]:With the rapid development of trade between China and the United States, friction in the field of intellectual property rights has become the focus of debate between the two countries. In recent years, the United States has mainly investigated China's exports to the United States according to Section 337. This paper introduces the historical process of friction and the "337 investigation". In general. It is found that in recent years, there are more and more "337 surveys" and the types of products involved are more and more extensive, and the friction is mainly due to the system differences, trade imbalance and weak awareness of protection, and so on. The Chinese government and enterprises should adopt appropriate strategies to reduce intellectual property friction.
