【摘要】：伊朗核問(wèn)題引發(fā)了聯(lián)合國(guó)、歐盟和美國(guó)對(duì)其進(jìn)行的經(jīng)濟(jì)制裁。聯(lián)合國(guó)通過(guò)的對(duì)伊朗制裁決議構(gòu)成各成員國(guó)的義務(wù)。歐盟和美國(guó)對(duì)伊朗制裁的立法,已全面禁止歐盟區(qū)域內(nèi)和美國(guó)國(guó)內(nèi)幾乎所有與伊朗有關(guān)的貿(mào)易往來(lái)和貨物運(yùn)輸。然而,為達(dá)到其政治和經(jīng)濟(jì)的目的,歐盟和美國(guó)不斷修改制裁法,使其單邊制裁在域外產(chǎn)生效力,適用于全球的航運(yùn)經(jīng)營(yíng)者。這對(duì)我國(guó)公司開展伊朗業(yè)務(wù)產(chǎn)生了重大影響。 本文通過(guò)分析聯(lián)合國(guó)、歐盟和美國(guó)對(duì)伊朗制裁的現(xiàn)狀,總結(jié)出各制裁法的適用主體和對(duì)國(guó)際進(jìn)出口貨物種類的限制。通過(guò)分析租船合同合法貨物所適用的國(guó)內(nèi)、國(guó)際法依據(jù)、美國(guó)和歐盟對(duì)伊朗制裁法的域外效力,進(jìn)而總結(jié)出目前國(guó)際上對(duì)伊朗制裁的各項(xiàng)措施,對(duì)租船合同合法貨物產(chǎn)生的影響。 本文分三章進(jìn)行論述,第一章介紹目前對(duì)伊朗制裁的立法情況和貨物限制。第二章分析判斷租船合同合法貨物的國(guó)內(nèi)法和國(guó)際法依據(jù),其中以我國(guó)《刑法》中相關(guān)規(guī)定為例進(jìn)行研究。第三章探討美國(guó)和歐盟單邊制裁法對(duì)判斷貨物是否合法時(shí)的效力,并對(duì)租船合同當(dāng)事人提供了幾點(diǎn)建議。
[Abstract]:The Iran nuclear issue led to the United Nations, the European Union and the United States for economic sanctions by the United Nations resolution on sanctions against Iran constitute the obligations of the member states. The European Union and the United States legislation of sanctions against Iran, has banned in European region and the United States and Iran almost all the domestic trade and transport of goods. However,, to achieve its political and economic purposes, the European Union and the United States continue to modify the law sanctions, unilateral sanctions in the extraterritorial effect, suitable for global shipping operators. It had a great influence on our company to carry out business in Iran.
In this paper, through the analysis of the United Nations, the European Union and the United States the status quo of sanctions against Iran, summed up the subject of the sanctions law and restrictions on international import and export cargo types. Through the analysis of the contract legal goods for domestic and international law basis, the effectiveness of the United States and the European Union on Iran sanctions extraterritorial law, and summed up the the current measures of international sanctions against Iran, on charter legal goods produced.
This paper is divided into three chapters, the first chapter introduces the current legislative situation of sanctions against Iran and cargo restrictions. In the second chapter, analysis and judgment of charter party legitimate goods of domestic law and international law basis, with China's criminal law the relevant provisions stipulated in the < > as the case study. The third chapter discusses the United States and the EU unilateral sanctions on the judgement of effectiveness the goods are legal, and some suggestions on the charter party.
