【摘要】：網(wǎng)絡(luò)攻擊,這個聽起來猶如電影大片的詞匯近年來已進(jìn)入人們視野。不同于以往的傳統(tǒng)攻擊,它往往采用隱秘、迅速的方式進(jìn)行。很多攻擊事件可能媒體還來不及報道,就已經(jīng)完成使命并“功成身退”。與其快速的攻擊方式不同的是它所帶來的后果。一次網(wǎng)絡(luò)攻擊不僅會影響虛擬世界的秩序,還會延伸到現(xiàn)實世界,即通過互聯(lián)網(wǎng)攻擊工控系統(tǒng)。近年來,專門針對國家的網(wǎng)絡(luò)攻擊并不罕見,“震網(wǎng)”(英文名稱為Stuxnet)特種病毒對西門子工業(yè)控制軟件SIMATIC WinCC的攻擊便是現(xiàn)代網(wǎng)絡(luò)攻擊的典型代表�；ヂ�(lián)網(wǎng)世界的發(fā)展可謂日新月異,國際法方面相關(guān)的規(guī)定已不足以規(guī)制多元化的網(wǎng)絡(luò)行為。對此,國家之間不得不積極交流,爭取早日成立一部適用于互聯(lián)網(wǎng)的國際法律。此外,要實現(xiàn)國家網(wǎng)絡(luò)空間的安全,法律以外的努力也不可少,具體包括:制定國內(nèi)方針政策,積極實現(xiàn)國際合作,筑造網(wǎng)絡(luò)防御工程。雖然有學(xué)者認(rèn)為網(wǎng)絡(luò)戰(zhàn)爭在不遠(yuǎn)的將來會成為一種新的戰(zhàn)爭形勢,網(wǎng)絡(luò)技術(shù)也會作為武器,但是目前各國面對網(wǎng)絡(luò)問題基本都選擇了合作共贏。雖然與網(wǎng)絡(luò)發(fā)展的日新月異相比,網(wǎng)絡(luò)戰(zhàn)爭方面的法律研究還很有限,在一些重要的問題上各國也缺乏普遍共識,但筆者相信隨著法律的健全、實踐的增加和技術(shù)的革新,網(wǎng)絡(luò)空間會變得越來越有序。
[Abstract]:Network attack, this sounds like blockbuster movie words have entered the horizon in recent years. Different from the traditional attacks in the past, it is often used in secret, rapid way. Many attacks may also not have the media reports, the mission has been completed and "success back". Its fast attack is different it the consequences of a cyber attack will not only affect the virtual world order, but also extends to the real world, through the Internet attack control system. In recent years, specifically for the country's cyber attack is not rare, "Earthquake Network" (English name Stuxnet) special virus is a typical representative of modern cyber attacks on SIEMENS industrial control software SIMATIC WinCC attacks. The development is the Internet world change rapidly, the relevant provisions of international law is not enough to regulate the network for diversified. This, countries have to actively communicate, for the early establishment of an international law applicable to the Internet. In addition, to achieve national security in cyberspace, outside the law no less effort, including: the establishment of domestic policies, actively implement international cooperation, build the network defense project. Although some scholars believe that the network war as a new war situation in the near future, the network technology will be used as a weapon, but the basic network problems currently facing countries have chosen to win-win cooperation. Although compared with the development of the network change rapidly, legal research network war is still very limited in some important problem countries also lack of general consensus, but I believe that with the increase of the sound legal system, practice and innovation of technology, cyberspace will become more orderly.
