【摘要】：修訂后的《公司法》將公司注冊(cè)資本一次性足額繳納制度改變?yōu)榉制诶U納制度,引起公司設(shè)立時(shí)虛報(bào)注冊(cè)資本行為違法性評(píng)價(jià)標(biāo)準(zhǔn)的改變。注冊(cè)資本形成制度的改變也改變了《刑法》第一百五十八條虛報(bào)注冊(cè)資本罪社會(huì)危害性評(píng)價(jià)標(biāo)準(zhǔn),如果不及時(shí)修訂《刑法》第一百五十八條和相關(guān)的追訴標(biāo)準(zhǔn),無(wú)法實(shí)現(xiàn)國(guó)家對(duì)市場(chǎng)主體管理秩序行為的刑法保護(hù)。
[Abstract]:The revised Company Law changed the system of full payment of company's registered capital in one time to the system of payment by installment, which caused the change of the evaluation standard of illegal behavior of false statement of registered capital when the company was established. The change of the system of registered capital formation has also changed the evaluation standard of the social harmfulness of the crime of false reporting of registered capital in Article 158 of the Criminal Law. If the article 158 of the Criminal Law and the relevant standards of prosecution are not amended in time, It is impossible to realize the criminal law protection of the administrative order of the market subject.
