【摘要】：目前 ,中國頒布實(shí)施的保險(xiǎn)法律只有保險(xiǎn)基本法———《保險(xiǎn)法》 ,既包括保險(xiǎn)合同法律規(guī)范 ,又包括保險(xiǎn)公司法及監(jiān)督管理法律規(guī)范 ;保險(xiǎn)特別法———《海商法》有關(guān)海上保險(xiǎn)合同的法律規(guī)定適用海上保險(xiǎn)活動部門規(guī)章和規(guī)范性文件數(shù)量很多 ,但其效力微弱。根據(jù)世貿(mào)組織法律要求 ,中國的保險(xiǎn)法律法規(guī)在不斷完善的基礎(chǔ)上應(yīng)逐步取消對內(nèi)資、外資保險(xiǎn)公司不同的法律規(guī)定和限制 ,將逐步形成劃一的國際化程度較高的保險(xiǎn)法律體系。即取消國內(nèi)、涉外保險(xiǎn)法律的不同規(guī)定 ,使中國的保險(xiǎn)法上升為具有國際性的法律。根據(jù)中國《保險(xiǎn)法》頒布實(shí)施以來的實(shí)踐 ,以及中國入世與保險(xiǎn)市場開放承諾的法律要求 ,對《保險(xiǎn)法》的修改成為當(dāng)務(wù)之急
[Abstract]:At present, the only insurance law promulgated and implemented in China is the basic Law of Insurance-the Insurance Law, which includes not only the legal norms of insurance contracts, but also the legal norms of insurance company law and supervision and management.The special law of insurance-"Maritime Law" applies a lot of regulations and normative documents to marine insurance activities, but its effectiveness is weak.In accordance with the requirements of the WTO law, China's insurance laws and regulations should gradually eliminate different legal provisions and restrictions on domestic and foreign insurance companies on the basis of continuous improvement.Will gradually form a uniform degree of internationalization of the higher degree of insurance legal system.That is, to abolish the different provisions of the domestic and foreign insurance laws, so that China's insurance law has become an international law.According to the practice since the promulgation and implementation of China's Insurance Law, as well as the legal requirements of China's accession to the WTO and the opening up of the insurance market, it is imperative to amend the Insurance Law.
