【摘要】：相對(duì)大型企業(yè),中小企業(yè)具有明顯的特點(diǎn),并由此產(chǎn)生對(duì)公司法的不同需求。公司法的適應(yīng)性品格要求公司法充分考慮中小企業(yè)的特殊需求,并作出與之相適應(yīng)的安排和調(diào)整。西方發(fā)達(dá)國家的公司法的不斷改革無不印證了這一觀點(diǎn)。我國公司法適應(yīng)性品格受到一定程度的壓抑,現(xiàn)行公司法對(duì)中小企業(yè)的調(diào)整仍有待進(jìn)一步的完善。
[Abstract]:Compared with large enterprises, small and medium-sized enterprises have obvious characteristics, and have different demands on company law. The adaptability character of company law requires that the special needs of small and medium-sized enterprises be fully taken into account in company law. And make corresponding arrangement and adjustment. The constant reform of company law in western developed countries has confirmed this view. The adaptability character of our company law is suppressed to a certain extent. The adjustment of the current company law to the small and medium-sized enterprises still needs to be further consummated.
