【摘要】：正當(dāng)前一段時間以來,因受國際金融危機和世界經(jīng)濟衰退的影響,公司經(jīng)營困難引發(fā)的公司強制清算案件大幅度增加。雖然公司法和最高人民法院《關(guān)于適用公司法若干問題的規(guī)定(二)》(以下簡稱公司法司法解釋(二))對公司強制清算案件審理中的有關(guān)問題已作出規(guī)定,但鑒于該類案件非訟程序的特點和目前清算
[Abstract]:Just before a period of time, due to the impact of the international financial crisis and the global economic recession, the company operating difficulties caused by the cases of compulsory liquidation of companies greatly increased.
