將過去 2 0年的規(guī)劃改革發(fā)展劃分為兩個階段 ,分析指出 ,1 990年《城市規(guī)劃法》作為現(xiàn)行規(guī)劃制度的集中體現(xiàn) ,反映出規(guī)劃改革發(fā)展道路漸進(jìn)的特征。在歷史地和批判性地剖析規(guī)劃法的內(nèi)在特點(diǎn)基礎(chǔ)上 ,文章進(jìn)一步指出 ,由于受到制度性的約束 ,規(guī)劃法在整體定位上存在缺陷 ,有濃厚的“部門”法的色彩。規(guī)劃法修訂工作面臨重大的機(jī)遇 ,盡管規(guī)劃制度的改革將仍然是漸進(jìn)的 ,但是應(yīng)對漸進(jìn)的方向做出調(diào)整 ,制定《城鄉(xiāng)規(guī)劃法》 ,并在此過程中 ,努力擴(kuò)大規(guī)劃的權(quán)力空間 ,提升規(guī)劃的政治地位 ,以適應(yīng)社會主義市場經(jīng)濟(jì)下政府職能轉(zhuǎn)變的要求。
