【摘要】：價(jià)值論、認(rèn)識(shí)論和系統(tǒng)論等是司法改革評(píng)價(jià)的理論基礎(chǔ),文章以司法評(píng)價(jià)理論為基礎(chǔ),從主體評(píng)價(jià)視角出發(fā),綜合運(yùn)用主觀評(píng)價(jià)法、統(tǒng)計(jì)數(shù)據(jù)的客觀評(píng)價(jià)法以及系統(tǒng)模型的綜合評(píng)價(jià)法,通過(guò)選取司法改革評(píng)價(jià)指標(biāo)中的評(píng)價(jià)司法規(guī)律標(biāo)準(zhǔn)和公眾感受標(biāo)準(zhǔn),以民事訴訟程序運(yùn)用者的視角為例,對(duì)司法權(quán)運(yùn)行機(jī)制進(jìn)行評(píng)價(jià)分析。文章認(rèn)為,應(yīng)以高品質(zhì)的司法產(chǎn)品回應(yīng)用戶的體驗(yàn)期待,尋找有效的交互技巧,設(shè)計(jì)更為開(kāi)放的系統(tǒng)、更為公開(kāi)的參與方式,使得利用者充分認(rèn)識(shí)司法權(quán)運(yùn)行機(jī)制的屬性、規(guī)律,進(jìn)而獲得利用者的理解和支持;同時(shí)更應(yīng)積極探索利用者對(duì)司法運(yùn)行機(jī)制的公正、平等價(jià)值的根本需求,通過(guò)司法權(quán)運(yùn)行機(jī)制自身改進(jìn),塑造使用者新的體驗(yàn)期待和體驗(yàn)感知,真正將"用戶體驗(yàn)"納入到法治、司法的軌道,實(shí)現(xiàn)對(duì)用戶體驗(yàn)的創(chuàng)造性轉(zhuǎn)換。
[Abstract]:Axiology, epistemology and system theory are the theoretical basis of judicial reform evaluation. Based on the judicial evaluation theory, this paper takes the perspective of civil procedure operator as an example by comprehensively using subjective evaluation method, objective evaluation method of statistical data and comprehensive evaluation method of system model, by selecting the evaluation judicial law standard and public feeling standard in the evaluation index of judicial reform. The operation mechanism of judicial power is evaluated and analyzed. The paper holds that high quality judicial products should be used to respond to users' experience expectations, to find effective interactive skills, to design more open systems and more open ways of participation, so that users can fully understand the attributes and laws of judicial power operation mechanism, and then obtain the understanding and support of users. At the same time, we should actively explore the fundamental needs of users for the justice and equal value of the judicial operation mechanism, shape the user's new experience expectation and experience perception through the improvement of the judicial power operation mechanism itself, and truly bring the "user experience" into the track of the rule of law and the administration of justice, so as to realize the creative transformation of the user experience.
