【摘要】：偵查監(jiān)督案件公開審查是對逮捕案件進(jìn)行司法審查的必然要求,是公民參與司法及深化檢務(wù)公開的合理路徑,也是克服"社會危險性"判斷主觀化的有效途徑。應(yīng)通過審查逮捕工作的適度公開,推動審查逮捕案件訴訟構(gòu)造的建立,實現(xiàn)"兼聽則明";通過引入第三方人員參與公開審查,增加外部監(jiān)督的力度,增強(qiáng)司法透明度,提升司法公信力;通過偵查監(jiān)督案件公開審理,引入公眾判斷標(biāo)準(zhǔn),對"社會危險性"判斷提供參考,進(jìn)而減輕辦案壓力,減少社會矛盾。
[Abstract]:Public examination of investigation and supervision cases is an inevitable requirement for judicial review of arrest cases, a reasonable way for citizens to participate in justice and deepen the publicity of prosecution affairs, and an effective way to overcome the subjective judgment of "social danger". Through the proper publicity of the examination and arrest work, we should promote the establishment of the litigation structure of the examination of arrest cases, and realize "both hearing and making clear"; Through the introduction of third-party personnel to participate in public review, increase the intensity of external supervision, enhance judicial transparency, enhance the credibility of the judiciary; Through the public trial of investigation and supervision cases, the public judgment standard is introduced to provide reference for the judgment of "social danger", so as to reduce the pressure of handling cases and reduce social contradictions.
