【摘要】：社會生活中,只要人與人的交往存在、個體利益和個體差異存在,矛盾糾紛就不可避免,為了維護社會的和諧穩(wěn)定,必須建立有效地糾紛解決機制。而且,隨著人類社會的不斷發(fā)展,人們的交往活動日益增多,利益關(guān)系也變的更加復(fù)雜,社會矛盾呈現(xiàn)出多元化的趨勢。民間調(diào)解作為一種糾紛解決方式,經(jīng)過幾千年的傳承,在我們國家有著深厚的基礎(chǔ)。它以民間力量自治主導(dǎo),有高效便民、及時靈活的特性,與政府主導(dǎo)的訴訟方式正好形成互補。從國外的情況看,那些實現(xiàn)了法治現(xiàn)代化的西方國家,也正將目光轉(zhuǎn)向民間調(diào)解,試圖建立多元化的糾紛解決機制。而我們這方面卻顯得滯后——這十幾年間我們努力完善法治,去忽視了其它非訴訟的糾紛解決方式。隨之而來的是訴訟案件的急劇增加,司法系統(tǒng)難以應(yīng)對,以及傳統(tǒng)的非訴訟糾紛解決方式的弱化。正如費孝通先生所說,法治的好處尚未完全得到,拋棄傳統(tǒng)的惡果卻已顯現(xiàn)。本文以和諧社會視野下的民間調(diào)解為題,研究民間調(diào)解的目的正是為了服務(wù)于和諧社會。 本文第一部分首先介紹了民間調(diào)解的基本理論,包括民間調(diào)解的概念、產(chǎn)生原因、種類和特征以及運行模式。第二部分是分析民間調(diào)解對于構(gòu)建和諧社會的意義,也就是為什么要研究民間調(diào)解,正是由于民間調(diào)解能夠為構(gòu)建和諧社會發(fā)揮作用。第三、第四部分則是對民間調(diào)解的狀況調(diào)查和分析,通過對民間調(diào)解的歷史演進、民間調(diào)解的常見形式、民間調(diào)解的時政調(diào)查和域外民間調(diào)解的情況考察,了解民間調(diào)解的狀況,并通過對它的狀況分析揭示傳統(tǒng)民間調(diào)解的興盛原因和現(xiàn)有民間調(diào)解存在的問題。最后,第五部分談了一下對于完善民間調(diào)解服務(wù)和諧社會的構(gòu)想。
[Abstract]:In social life, as long as human interaction exists, individual interests and individual differences exist, contradictions and disputes are inevitable. In order to maintain social harmony and stability, it is necessary to establish an effective dispute resolution mechanism. Moreover, with the continuous development of human society, people's communication activities are increasing day by day, interest relations become more complex, social contradictions show the trend of diversification. As a dispute resolution method, folk mediation has a profound foundation in our country after thousands of years of inheritance. It is self-governing by folk power, efficient and convenient for the people, timely and flexible, which is complementary to the government-led litigation mode. From abroad, the western countries which have realized the modernization of the rule of law are turning their attention to folk mediation and trying to establish a pluralistic dispute settlement mechanism. But we are lagging behind-we have been trying to perfect the rule of law and ignore other non-litigation dispute resolution methods over the past decade. Followed by the sharp increase in litigation cases, the judicial system is difficult to deal with, and the traditional non-litigation dispute resolution weakening. As Mr. Fei Xiaotong said, the benefits of the rule of law have not yet been fully attained, but the consequences of abandoning tradition have emerged. This paper focuses on the folk mediation in the view of harmonious society, and the purpose of the study is to serve the harmonious society. The first part of this paper introduces the basic theory of folk mediation, including the concept, causes, types and characteristics of folk mediation, as well as the mode of operation. The second part is to analyze the significance of folk mediation for the construction of a harmonious society, that is, why to study folk mediation, it is precisely because folk mediation can play a role in the construction of a harmonious society. The third and the fourth part is the investigation and analysis of the situation of the folk mediation, through the historical evolution of the folk mediation, the common forms of the folk mediation, the current political investigation of the folk mediation and the investigation of the situation of the folk mediation outside the territory. To understand the status of folk mediation, and through the analysis of its status to reveal the reasons for the prosperity of traditional folk mediation and the existing problems of folk mediation. Finally, the fifth part discusses the idea of perfecting the folk mediation service harmonious society.
