廣東省佛山市鎮(zhèn)(街)法律監(jiān)督工作調(diào)查研究

【摘要】:本文是在廣東省“簡政強(qiáng)鎮(zhèn)”改革的背景下,以2008年至今佛山市檢察機(jī)關(guān)鎮(zhèn)(街)檢察室的工作模式和實(shí)際情況為調(diào)研對(duì)象,結(jié)合我國鄉(xiāng)鎮(zhèn)檢察室的發(fā)展歷史、作用及局限性,深入分析我國構(gòu)建鎮(zhèn)(街)法律監(jiān)督工作機(jī)制的必要性與可行性,并通過比較我國其他地區(qū)開展鎮(zhèn)(街)法律監(jiān)督工作的不同模式,在分析各種模式的利弊基礎(chǔ)上,提出了在鎮(zhèn)(街)基層建立法律監(jiān)督工作機(jī)制的整體方案建議。 本文分為五個(gè)部分。 第一部分論述了調(diào)研的目的和意義:首先介紹了“簡政強(qiáng)鎮(zhèn)”改革的調(diào)研背景;其次說明了期待通過實(shí)證考察達(dá)到推動(dòng)我國鎮(zhèn)(街)法律監(jiān)督工作機(jī)制改革的目的;再次闡述了本文的理論意義與實(shí)踐價(jià)值。本文在相同領(lǐng)域的理論研究屬于首創(chuàng),填補(bǔ)了我國關(guān)于鎮(zhèn)(街)法律監(jiān)督工作機(jī)制研究的空白;提出的建構(gòu)對(duì)策有利于促進(jìn)我國鎮(zhèn)(街)法律監(jiān)督工作機(jī)制的建立與完善,,并且,佛山市檢察機(jī)關(guān)推行的鎮(zhèn)(街)法律監(jiān)督工作機(jī)制屬于在現(xiàn)有檢察體制內(nèi)進(jìn)行的改革,不需要突破現(xiàn)有法律法規(guī),有很強(qiáng)的實(shí)際推廣價(jià)值。 第二部分闡述了調(diào)研的方法和對(duì)象:本文采取了比較分析、歷史分析和實(shí)證分析的研究方法,調(diào)研對(duì)象為佛山市檢察院2008年以來在順德區(qū)樂從鎮(zhèn)等33個(gè)鎮(zhèn)(街)基層組織創(chuàng)造性地設(shè)立鎮(zhèn)(街)檢察室的工作思路、機(jī)制構(gòu)建以及實(shí)際運(yùn)作方式、運(yùn)作成效等。 第三部分詳細(xì)闡述了調(diào)研結(jié)果:首先介紹了佛山市檢察機(jī)關(guān)開展鎮(zhèn)(街)法律監(jiān)督工作的背景;其次認(rèn)真梳理了2008年以來佛山市檢察機(jī)關(guān)鎮(zhèn)(街)檢察工作的人員配備、工作職責(zé)、工作成效和主要問題。 第四部分分析與討論:重點(diǎn)論述了構(gòu)建鎮(zhèn)(街)法律監(jiān)督機(jī)制的必要性和可行性,并結(jié)合我國鄉(xiāng)鎮(zhèn)檢察工作的歷史沿革,比較分析了我國派出(聯(lián)系)機(jī)構(gòu)的兩種最主要的模式,得出檢察室模式更適合我國國情的結(jié)論。 第五部分結(jié)論與建議:提出設(shè)立鎮(zhèn)(街)檢察機(jī)構(gòu)應(yīng)當(dāng)遵循對(duì)應(yīng)設(shè)立、獨(dú)立工作和目標(biāo)管理原則,名稱應(yīng)統(tǒng)一為“檢察室”,組織體制結(jié)構(gòu)設(shè)置應(yīng)當(dāng)是“立體的二級(jí)結(jié)構(gòu)”,職能定位應(yīng)以強(qiáng)化法律監(jiān)督職能為基礎(chǔ),以服務(wù)業(yè)務(wù)部門為職能載體。
[Abstract]:Under the background of the reform of "Jianzheng strong Town" in Guangdong Province, this paper takes the working mode and actual situation of the procuratorial office of Foshan procuratorial organ since 2008 as the research object, and combines the development history, function and limitation of the procuratorial office of the township in our country. This paper deeply analyzes the necessity and feasibility of constructing the mechanism of legal supervision in towns (streets) in our country, and compares the different modes of legal supervision of towns (streets) in other areas of our country, on the basis of analyzing the advantages and disadvantages of the various models. Proposed in the town (street) grass-roots establishment legal supervision work mechanism the overall plan proposal. This paper is divided into five parts. The first part discusses the purpose and significance of the investigation: firstly, it introduces the research background of the reform of "simple and strong town"; secondly, it explains the purpose of promoting the reform of the legal supervision mechanism of our country's towns (streets) through empirical investigation. Again, this paper expounds the theoretical significance and practical value. The theoretical research in the same field is the first in this paper, which fills the blank of the research on the legal supervision mechanism of the town (street) in our country. The constructive countermeasures put forward are conducive to the establishment and perfection of the mechanism of legal supervision in towns (streets) in our country. Moreover, the mechanism of legal supervision in towns (streets) implemented by procuratorial organs in Foshan belongs to the reform carried out within the existing procuratorial system. Do not need to break through the existing laws and regulations, has a strong practical promotion value. The second part describes the research methods and objects: this paper adopts comparative analysis, historical analysis and empirical analysis. The object of investigation is the creative establishment of procuratorial office in 33 towns (streets) such as Lecong Town Shunde District since 2008 by Foshan Procuratorate. The third part elaborated the investigation result in detail: first introduced the Foshan procuratorial organ to carry out the town (street) the legal supervision work background; Secondly, the author carefully combs the staffing, duties, results and main problems of the procuratorial work in Foshan since 2008. The fourth part analyzes and discusses the necessity and feasibility of constructing the legal supervision mechanism of the town (street), and combines the historical evolution of the procuratorial work of the township in our country. This paper compares and analyzes the two most important modes of the dispatch agencies in China, and draws the conclusion that the mode of procuratorial office is more suitable for the national conditions of our country. Part V conclusions and suggestions: it is suggested that the establishment of a town (street) procuratorial organ should follow the principles of corresponding establishment, independent work and objective management, that the name should be unified as "procuratorial room", and that the organizational system structure should be set up as "three-dimensional secondary structure". The function orientation should be based on strengthening the legal supervision function and the service business department should be the function carrier.
