我國(guó)檢察委員會(huì)制度若干問(wèn)題研究

【摘要】:我國(guó)的檢察委員會(huì)制度,是在借鑒蘇聯(lián)檢察制度的基礎(chǔ)上同我國(guó)的國(guó)情相結(jié)合的產(chǎn)物,是民主制在檢察體制建設(shè)中的折射。隨著我國(guó)司法改革進(jìn)程的推進(jìn),檢察改革也正處于進(jìn)行時(shí),檢察委員會(huì)作為我國(guó)檢察制度較為典型的一部分,不可避免地參與到了改革浪潮之中。從1999年檢察委員會(huì)制度開(kāi)始改革以來(lái),檢察委員會(huì)的改革工作取得了一定的成效。不過(guò),總體來(lái)看,雖然這些改革在一定程度上強(qiáng)化了檢察委員會(huì)的職能,但均是局部性改良,檢察委員會(huì)的職能并未得到實(shí)質(zhì)性的優(yōu)化。同時(shí),改革也還面臨著一定的理論困境和目的困境。為了能對(duì)檢察委員會(huì)制度的改革有所裨益,本文主要分四個(gè)部分,從四個(gè)方面分別對(duì)我國(guó)檢察委員會(huì)制度進(jìn)行了研究:第一部分,主要以我國(guó)建國(guó)后的規(guī)范性法律文件為基礎(chǔ),從四個(gè)方面對(duì)我國(guó)檢察委員會(huì)制度的演變過(guò)程進(jìn)行梳理和比較;第二部分,主要從改革的角度討論了關(guān)于我國(guó)檢察委員會(huì)制度的存與廢的問(wèn)題,并提出和論證了我國(guó)檢察委員會(huì)制度應(yīng)當(dāng)保留的觀點(diǎn);第三部分,分別從發(fā)展的視角闡述了我國(guó)檢察委員會(huì)制度的改革方向,從權(quán)力運(yùn)行的角度分析了檢察委員會(huì)與檢察院內(nèi)外部各方的關(guān)系;從對(duì)“重大”進(jìn)行合理解釋的角度,對(duì)檢察委員會(huì)的職權(quán)范圍進(jìn)行了重新分析;從檢察委員會(huì)職能的“二元性”,提出了對(duì)我國(guó)檢察委員會(huì)決策程序進(jìn)行“二元化”模式構(gòu)建的設(shè)想;最后一部分,,通過(guò)對(duì)檢察委員會(huì)與審判委員會(huì)進(jìn)行簡(jiǎn)單的對(duì)比,分析了檢察委員會(huì)與審判委員會(huì)在本質(zhì)上的區(qū)別。
[Abstract]:The procuratorial committee system of our country is the product of combining the procuratorial system of the Soviet Union with the national conditions of our country and the refraction of democracy in the construction of procuratorial system. With the advancement of judicial reform in our country, the procuratorial committee, as a typical part of the procuratorial system in our country, inevitably participates in the tide of reform. Since the reform of the procuratorial committee system began in 1999, the reform of the procuratorial committee has achieved certain results. However, in general, although these reforms have strengthened the functions of the procuratorial committee to some extent, they are all local improvements, and the functions of the procuratorial committee have not been substantially optimized. At the same time, the reform is also faced with a certain theoretical and objective dilemma. In order to benefit the reform of the procuratorial committee system, this paper is divided into four parts. The first part is mainly based on the normative legal documents after the founding of the people's Republic of China. The evolution process of the procuratorial committee system in China is combed and compared from four aspects. The second part mainly discusses the problem of the existence and abolishment of the procuratorial committee system from the angle of reform, and puts forward and demonstrates the viewpoint that the procuratorial committee system of our country should keep; The third part expounds the reform direction of the procuratorial committee system from the perspective of development and analyzes the relationship between the procuratorial committee and the internal and external parties of the procuratorate from the angle of power operation. From the angle of reasonable explanation of "important", this paper reanalyzes the terms of reference of the procuratorial committee; From the duality of the function of the procuratorial committee, this paper puts forward the idea of constructing the dualistic mode of the decision-making procedure of the procuratorial committee in our country. In the last part, the author analyzes the essential difference between the procuratorial committee and the trial committee through a simple comparison between the procuratorial committee and the trial committee.
