【摘要】：政治與法治之間的關(guān)系問(wèn)題是人類(lèi)追求良善社會(huì)的永恒話(huà)題。從本體論層面來(lái)看,各國(guó)司法都具有政治和法治雙重屬性。司法的政治性及其制度表達(dá)決定于"政治國(guó)情",而司法的運(yùn)行則詮釋與實(shí)踐其政治性所承載的各種政治價(jià)值與需求。由于當(dāng)代中國(guó)獨(dú)具特色和優(yōu)勢(shì)的黨政體制及其政權(quán)組織結(jié)構(gòu),我國(guó)司法具有鮮明的政治性;同時(shí),由于實(shí)行依法治國(guó)、建設(shè)法治國(guó)家,我國(guó)司法在實(shí)踐中又表現(xiàn)為向法治性回歸的演進(jìn)趨勢(shì)。因此,當(dāng)代中國(guó)司法的政治與法治關(guān)系表現(xiàn)為體制上的"政法模式"和司法運(yùn)行中的"法政模式"并存的鮮明特征。
[Abstract]:The relationship between politics and rule of law is an eternal topic in the pursuit of good society. From the ontological level, the judicature of all countries has the dual attribute of politics and rule of law. The political nature of judicature and its system expression are determined by "political situation", and the operation of judicature interprets and practices all kinds of political values and demands carried by its political nature. Because of the unique and advantageous party and government system and its political organization structure in contemporary China, the administration of justice in our country has a distinct political character; at the same time, due to the implementation of the rule of law and the construction of a country ruled by law, In practice, the judicial system in our country shows the trend of returning to the rule of law. Therefore, the relationship between the politics and the rule of law in contemporary Chinese judicature is characterized by the coexistence of the "political-legal mode" in the system and the "legal-political mode" in the judicial operation.
