【摘要】：構(gòu)建覆蓋城鄉(xiāng)的公共法律服務(wù)體系是黨的十八屆四中全會提出的新目標(biāo),標(biāo)志著我國公共法律服務(wù)體系建設(shè)已經(jīng)進入了一個嶄新的時代。政府購買公共法律服務(wù)作為我國公共法律服務(wù)體系的重要組成部分,其在為發(fā)展社會主義市場經(jīng)濟、繁榮法律服務(wù)市場、促進服務(wù)經(jīng)濟社會轉(zhuǎn)型升級、化解社會矛盾糾紛、增進民生福祉等方面發(fā)揮著極其重要的作用,同時也是落實黨的十八大報告有關(guān)更加注重發(fā)揮法治在國家治理和社會管理中的重要作用的具體體現(xiàn)。目前,我國公共法律服務(wù)體系建設(shè)仍處于起步階段,政府購買公共法律服務(wù)的各項制度和措施仍不完善。法律服務(wù)在公共產(chǎn)品領(lǐng)域內(nèi)的購買,不僅是政府向社會力量購買公共產(chǎn)品的大膽探索,也是我國法治進程中的必然趨勢。政府應(yīng)當(dāng)以國情為基礎(chǔ),通過借鑒國外先進的社會管理經(jīng)驗和模式,及時地轉(zhuǎn)變傳統(tǒng)的思維模式和管理方法,推動我國政府購買公共法律服務(wù)順利進行。我國的公共法律服務(wù)體系建設(shè)是一個龐大并且復(fù)雜的工程,本文從購買的角度出發(fā),對我國政府購買公共法律服務(wù)的相關(guān)問題進行了研究。首先,本文對政府購買公共法律服務(wù)的基礎(chǔ)理論進行了全面的概述,為政府購買法律服務(wù)提供了理論依據(jù);然后,以地方公共法律服務(wù)建設(shè)情況為依據(jù),從法律法規(guī)、購買范圍、購買程序、隊伍建設(shè)、資金保障、監(jiān)督機制等方面,全面剖析了政府購買過程中存在的問題;最后,根據(jù)本文所提出的問題,從強化法制建設(shè)、拓展購買范圍、規(guī)范購買程序、擴大人員規(guī)模、增加資金投入、完善監(jiān)督機制等六方面的措施來不斷地完善政府的購買機制,從而確保我國公共法律服務(wù)事業(yè)持續(xù)穩(wěn)定發(fā)展。
[Abstract]:The construction of public legal service system covering urban and rural areas is a new goal put forward by the fourth Plenary session of the 18th CPC Central Committee, which indicates that the construction of public legal service system in China has entered a new era. As an important part of our country's public legal service system, the purchase of public legal services by the government is aimed at developing the socialist market economy, prospering the legal service market, promoting the transformation and upgrading of the service economy and society, and resolving social contradictions and disputes. The promotion of people's livelihood and welfare plays an extremely important role, and it is also a concrete embodiment of the implementation of the report of the 18th National Congress of the Party on paying more attention to giving play to the important role of the rule of law in national governance and social management. At present, the construction of public legal service system is still in its infancy, and the system and measures of government purchasing public legal service are still imperfect. The purchase of legal services in the field of public goods is not only a bold exploration for the government to purchase public goods from social forces, but also an inevitable trend in the process of ruling by law in our country. On the basis of national conditions, the government should change the traditional thinking mode and management method in time by drawing lessons from foreign advanced experience and mode of social management, so as to promote our government to purchase public legal services smoothly. The construction of public legal service system in China is a huge and complex project. First of all, this paper gives a comprehensive overview of the basic theory of government purchase of public legal services, which provides a theoretical basis for the government to purchase legal services; then, based on the construction of local public legal services, from the perspective of laws and regulations, In the aspects of purchase scope, purchase procedure, team building, fund guarantee, supervision mechanism and so on, the paper comprehensively analyzes the problems existing in the process of government purchase. Finally, according to the problems raised in this paper, we should strengthen the legal system construction and expand the scope of purchase. In order to ensure the continuous and stable development of the public legal service in our country, we should standardize the purchase procedure, expand the personnel scale, increase the investment of funds, perfect the supervision mechanism and so on.
