【摘要】：隨著互聯(lián)網(wǎng)這一新型媒體的發(fā)展，現(xiàn)代社會已經(jīng)步入了“人人都有麥克風(fēng)”的時代�；ヂ�(lián)網(wǎng)延伸了傳統(tǒng)媒體的邊界，豐富了傳統(tǒng)媒體的表達形式，大大拉近了媒體與受眾之間的距離。網(wǎng)絡(luò)傳媒不只是一種抽象的與公權(quán)相對應(yīng)的社會力量，它還是民意的代言人，是社會輿論的載體，，是公民行使憲法賦予的監(jiān)督權(quán)的重要渠道，是公民表達言論自由的重要平臺。伴隨著網(wǎng)絡(luò)輿論對法院審判的高度關(guān)注，由于網(wǎng)絡(luò)傳媒以道德、習(xí)慣作為評判是非的標(biāo)準(zhǔn)，其所內(nèi)含的非理性很可能影響甚至干涉法院的獨立、公正審判�；谶@樣的背景，身處網(wǎng)絡(luò)時代，如何實現(xiàn)網(wǎng)絡(luò)輿論背后的言論自由與法院審判背后的公正審判兩種價值的平衡，找尋二者之間的最佳契合點，顯得尤為重要。 本文通過全面分析網(wǎng)絡(luò)輿論對法院審判的影響，理性解讀二者之間的復(fù)雜關(guān)系，并借鑒國外相關(guān)經(jīng)驗，最后，對于實現(xiàn)網(wǎng)絡(luò)輿論與法院審判之間的良性互動筆者試著提出一些意見和建議。
[Abstract]:With the development of Internet, the modern society has entered the era of "everyone has microphone". Internet extends the boundary of traditional media, enriches the expression of traditional media, and draws the distance between media and audience. Network media is not only an abstract social force corresponding to public power, but also a spokesman for public opinion, a carrier of public opinion, an important channel for citizens to exercise their constitutional right of supervision, and an important platform for citizens to express their freedom of speech. Along with the network public opinion to the court trial high attention, because the network media regards the morals, the custom as the judgment right and wrong standard, it contains the irrational possibly to influence even interferes the court independence, the fair trial. Based on this background, how to realize the balance between the freedom of speech behind the network public opinion and the fair trial behind the court trial, and to find the best joint point between them, is particularly important in the network age. This paper analyzes the influence of network public opinion on the trial of the court, rationally interprets the complex relationship between the two, and draws lessons from the relevant experience of foreign countries. Finally, The author tries to put forward some opinions and suggestions to realize the benign interaction between network public opinion and court trial.
