【摘要】：法官懲戒制度的完善程度是衡量一個(gè)國(guó)家司法制度民主與否的重要標(biāo)志。不完善的法官懲戒制度不僅影響司法的權(quán)威性,而且威脅著司法獨(dú)立和司法公正。我國(guó)的法官懲戒制度極不完善,無(wú)論是立法還是具體實(shí)踐,都存在很多問(wèn)題,主要表現(xiàn)為法官懲戒機(jī)構(gòu)的設(shè)置及權(quán)力分配不合理、懲戒事由規(guī)定不科學(xué)、懲戒程序具有明顯的行政化色彩、懲戒措施沒(méi)有體現(xiàn)法官職業(yè)的特點(diǎn)。究其原因,主要在于我國(guó)特殊的國(guó)情、司法監(jiān)督制度不夠完善及法官素質(zhì)低下等。西方法官懲戒制度在制度與實(shí)踐方面都有值得我國(guó)借鑒之處。為完善與重構(gòu)我國(guó)的法官懲戒制度,須設(shè)立獨(dú)立的法官懲戒委員會(huì)、明確并細(xì)化法官懲戒事由、建立規(guī)范的懲戒程序以及規(guī)范懲戒措施。
[Abstract]:The perfection of judge's disciplinary system is an important symbol to measure the democracy of a country's judicial system. The imperfect system not only affects the judicial authority, but also threatens the judicial independence and justice. The judge disciplinary system in our country is very imperfect, whether in legislation or in practice, there are many problems, mainly manifested in the unreasonable setting and power distribution of the judge disciplinary institution, and the unscientific stipulation of disciplinary reasons. Disciplinary procedures have obvious administrative color, disciplinary measures do not reflect the characteristics of the profession of judges. The main reasons are the special situation of our country, the imperfect judicial supervision system and the low quality of judges. The system and practice of western judge disciplinary system are worthy of our country's reference. In order to perfect and reconstruct the judge disciplinary system in our country, it is necessary to set up an independent judge disciplinary committee, to clarify and refine the cause of the judge's punishment, to establish the standard disciplinary procedure and to standardize the disciplinary measures.
