【摘要】：無論就其深度還是廣度而言,業(yè)已啟動的司法體制機制改革充分體現(xiàn)了決策層推進國家治理體系現(xiàn)代化的愿望與決心。而要確保改革的預(yù)期效果得以達成,僅有世界觀意義上的縝密設(shè)計是不夠的,還需方法論層面上的科學(xué)指引。試點方法的大規(guī)模運用,無疑使當下的司法改革具有了濃郁的實驗色彩。而熟練掌握試點實驗方法,借助設(shè)計方案的周延性,充分評估改革舉措的實際效應(yīng),將有助于樹立其推廣價值。通過對域外經(jīng)驗的借鑒,結(jié)合諸項現(xiàn)實環(huán)境因素的考察,可以為法治中國的推進尋求切實可行的司法路徑。
[Abstract]:In terms of its depth and breadth, the reform of judicial system has fully reflected the desire and determination of the decision-makers to promote the modernization of the national governance system. In order to ensure that the expected effect of reform can be achieved, it is not enough to design meticulously in the sense of world view, but also need the scientific guidance of methodology. The large-scale application of the pilot method undoubtedly makes the current judicial reform have a strong experimental color. Mastering the experimental method skillfully and evaluating the actual effect of the reform fully with the help of the periodicity of the design plan will help to set up its popularizing value. Through the reference of the overseas experience and the investigation of various realistic environmental factors, we can find a feasible judicial path for the advancement of China ruled by law.
