【摘要】：近年來，，隨著互聯(lián)網(wǎng)技術(shù)的迅猛發(fā)展與普及應(yīng)用，網(wǎng)絡(luò)輿論對于刑事司法工作的關(guān)注日益加強(qiáng)。網(wǎng)絡(luò)輿論的監(jiān)督為刑事司法工作的公開透明起到了積極的推動作用，但與此同時(shí)，網(wǎng)絡(luò)媒體對于刑事案件的報(bào)道與傳播，也對刑事司法系統(tǒng)的獨(dú)立性構(gòu)成了挑戰(zhàn)。本文以網(wǎng)絡(luò)輿論對刑事司法獨(dú)立性的入侵現(xiàn)象及原因?yàn)榍腥朦c(diǎn)，探討刑事司法機(jī)關(guān)在面對網(wǎng)絡(luò)輿論壓力時(shí)應(yīng)當(dāng)堅(jiān)持的底線，以及可以考慮讓步的領(lǐng)域及范圍。
[Abstract]:In recent years, with the rapid development and popularization of Internet technology, the network public opinion is paying more and more attention to the criminal justice work. The supervision of network public opinion has played a positive role in promoting the openness and transparency of criminal justice, but at the same time, the network media's reporting and dissemination of criminal cases have also posed a challenge to the independence of the criminal justice system. Based on the phenomenon and reason of the network public opinion invading the independence of criminal justice, this paper discusses the bottom line that the criminal judicature should adhere to in the face of the pressure of network public opinion, as well as the field and scope that can be considered to compromise.
