【摘要】：在中國,司法解釋權(quán)是一種相對獨(dú)立的權(quán)力,判文解釋不屬于司法解釋,不具有司法解釋的效力�，F(xiàn)實(shí)生活中法官的能動性受到抑制,不少法官只是機(jī)械地適用法律,遠(yuǎn)不能適應(yīng)千變?nèi)f化的社會現(xiàn)實(shí)的司法需求,嚴(yán)格依法辦事的結(jié)果與"民意"相背的情形難以避免。在現(xiàn)代社會中,如何吸納民意已成為民眾參與社會管理、參與司法和對司法實(shí)施監(jiān)督的重要問題。應(yīng)正確認(rèn)識司法實(shí)踐中運(yùn)用判文解釋的必然性及其與吸納民意的內(nèi)在關(guān)系;通過判文解釋有效吸納民意,化解司法和民意沖突,實(shí)現(xiàn)社會管理創(chuàng)新。
[Abstract]:In China, the power of judicial interpretation is a relatively independent power, which does not belong to judicial interpretation and does not have the effect of judicial interpretation. In real life, the active role of judges is restrained, many judges only apply the law mechanically, far from adapting to the judicial needs of the ever-changing social reality, and it is difficult to avoid the situation that the result of handling affairs strictly according to law is contrary to "public opinion". In modern society, how to absorb public opinion has become an important issue for people to participate in social management, to participate in the administration of justice and to supervise judicial implementation. It is necessary to correctly understand the inevitability of applying the interpretation of judgment in judicial practice and its internal relationship with the acceptance of public opinion, through which we can effectively absorb public opinion, resolve the conflict between judicature and public opinion, and realize the innovation of social management.
