【摘要】：正我國憲法規(guī)定由檢察機關(guān)行使的"法律監(jiān)督權(quán)",體現(xiàn)在民事程序中的權(quán)限通稱為民事檢察權(quán),具體表現(xiàn)為四種民事檢察權(quán)的形態(tài)或權(quán)能:一是審判監(jiān)督權(quán),即針對法院審判行為的法律監(jiān)督權(quán);二是民事公訴權(quán),即針對危害公共利益行為的法律監(jiān)督權(quán);三是執(zhí)行監(jiān)督權(quán),即針對法院執(zhí)行行為的法律監(jiān)督權(quán);四是執(zhí)行協(xié)助權(quán)或支持執(zhí)行權(quán),即針對妨礙法院執(zhí)行公務(wù)的社會行為的監(jiān)督權(quán)。換言之,
[Abstract]:The constitution of our country stipulates that the power of legal supervision exercised by the procuratorial organ is generally called civil procuratorial power, which is embodied in the power of civil procedure. It is embodied in four forms or functions of civil procuratorial power: the power of judicial supervision, that is, the power of legal supervision directed against the court's judicial acts; and the right of civil prosecution, that is, against acts endangering public interests. The power of legal supervision; the power of executive supervision, that is, the power of legal supervision directed against the court's execution; and the power of executive assistance or support for execution, that is, the power of supervision directed against social acts that impede the court's execution of official duties.
