【摘要】：正撤回起訴是指在審判過程中,人民檢察院發(fā)現(xiàn)所公訴的案件存在嚴重缺陷,進而向人民法院提出要求將案件撤回的刑事訴訟程序。目前,在基層檢察工作實踐中,存在適用撤回起訴程序不規(guī)范、撤回起訴隨意性較大的問題,不利于被告人權(quán)益的保護,浪費了訴訟資源,因此,亟須重新審視撤回起訴程序,加強對撤回起
