【摘要】：律師見證業(yè)務(wù)隨我國的改革開放被引入后曾獲得較快發(fā)展,但近年來我國的律師見證除了在僅存的強(qiáng)制見證領(lǐng)域外,幾乎銷聲匿跡,甚至逐漸淡出律師們的視野,這與國外律師見證業(yè)務(wù)長盛不衰的情形相差徑庭。為使律師見證業(yè)務(wù)在我國重獲生機(jī),有必要探究律師見證業(yè)務(wù)在我國所面臨的問題,并通過理論分析和實(shí)務(wù)探究,提出有針對(duì)性的建議,促進(jìn)律師見證業(yè)務(wù)的健康發(fā)展。 本文的思路是,先對(duì)律師見證在我國的發(fā)展概況進(jìn)行介紹,然后分析律師見證的基本理論,以便準(zhǔn)確把握律師見證業(yè)務(wù)獨(dú)特性,接著對(duì)律師見證業(yè)務(wù)的實(shí)務(wù)操作進(jìn)行研究,最后在分析我國律師見證所存在的問題的基礎(chǔ)上提出一些有針對(duì)性的建議。 第一章先對(duì)律師見證業(yè)務(wù)在我國的發(fā)展概況進(jìn)行回顧,通過梳理,律師見證業(yè)務(wù)在我國的發(fā)展可分為三個(gè)階段,即引入探索階段、迅速發(fā)展階段、勢(shì)微階段。 第二章主要概述律師見證的概念、性質(zhì)、特征、意義、效力及法律責(zé)任,通過與公證、法律審查等概念進(jìn)行區(qū)分,以便準(zhǔn)確把握律師見證業(yè)務(wù)的基本理論。 第三章主要對(duì)律師見證實(shí)務(wù)中的見證范圍、原則、程序、方法等問題進(jìn)行探究,并對(duì)常見的律師見證業(yè)務(wù)進(jìn)行了簡(jiǎn)要分析。 第四章主要是剖析我國律師見證業(yè)務(wù)所面臨的問題并為之提出有針對(duì)性的建議。
[Abstract]:With the introduction of China's reform and opening up to the outside world, the lawyer witness business has developed rapidly. But in recent years, except in the only field of compulsory witness, the lawyer witness almost disappeared, and even gradually faded out of the field of vision of lawyers. This and foreign lawyers witness the long-term business situation is different from the court. In order to bring the lawyer witness business back to life in our country, it is necessary to explore the problems faced by the lawyer witness business in our country, and through theoretical analysis and practical exploration, put forward targeted suggestions to promote the healthy development of the lawyer witness business. The idea of this paper is to introduce the development of lawyer witness in our country first, then analyze the basic theory of lawyer witness, in order to accurately grasp the uniqueness of lawyer witness business, and then study the practical operation of lawyer witness business. Finally, on the basis of analyzing the problems existing in the testimony of lawyers in our country, some pertinent suggestions are put forward. The first chapter reviews the development of lawyer witness business in China. Through combing, the development of lawyer witness business in China can be divided into three stages, namely, the introduction of exploration stage, the rapid development stage, and the potential micro-stage. The second chapter mainly summarizes the concept, nature, characteristics, significance, effectiveness and legal responsibility of lawyer witness, through distinguishing from notarization, legal review and other concepts, in order to accurately grasp the basic theory of lawyer witness business. The third chapter mainly explores the scope, principles, procedures, methods and other issues in the practice of lawyer witness, and briefly analyzes the common lawyer witness business. The fourth chapter analyzes the problems faced by lawyers in China and puts forward some suggestions.
