【摘要】：通過對河南鶴壁法院民事二審發(fā)回重審案件數(shù)量、趨勢、特征以及存在問題的調(diào)查研究,分析其中存在的主客觀規(guī)律,結(jié)合理論和實(shí)踐,提出解決問題的適應(yīng)性對策。發(fā)回重審制度是我國民事訴訟法規(guī)定的,民事案件經(jīng)二審程序?qū)徖砗蟮囊环N處理方法,與維持原判和改判相對應(yīng)。立法目的在于通過重新審理,消除原一審判決存在的事實(shí)不清或者程序不公情況。就鶴壁中院的審判實(shí)踐調(diào)研發(fā)現(xiàn),發(fā)回重審案件數(shù)量并沒有像其他地方法院那樣逐年遞增,相反在過去五年的時(shí)間,發(fā)回重審案件所占民事二審結(jié)案的比重逐年遞減,產(chǎn)生這一現(xiàn)象的原因值得探討。而在發(fā)回重審的案件中,按照司法統(tǒng)計(jì)分類標(biāo)準(zhǔn),以合同糾紛數(shù)量最多；將全年發(fā)回重審的數(shù)量分為四個(gè)季度分析,發(fā)現(xiàn)在第二季度和第四季度數(shù)量激增。鶴壁中院民事二審發(fā)回重審案件的這些迥異于其他法院的特點(diǎn),有其發(fā)生的獨(dú)特原因,既與“先天”有關(guān),又受到全國主要是所在省的審判考核制度和審務(wù)管理制度的影響�；揪S持在高位的發(fā)回重審比率,衍生出許多的問題。
[Abstract]:Based on the investigation and study of the number, trend, characteristics and existing problems of the civil retrial cases sent back to Hebi Court in Henan Province, the subjective and objective laws are analyzed, and the adaptive countermeasures to solve the problems are put forward in combination with the theory and practice. The system of retrial is stipulated in the Civil procedure Law of our country. A method of handling civil cases after being tried by the second instance procedure corresponds to the maintenance of the original judgment and the revision of the sentence. The purpose of the legislation is to eliminate the fact ambiguity or procedural injustice of the original first instance judgment through retrial. According to the trial practice of Hebi Intermediate people's Court, it is found that the number of retrial cases sent back is not increasing year by year as other local courts do. On the contrary, in the past five years, the proportion of civil second instance cases sent back to trial has decreased year by year. The causes of this phenomenon are worth exploring. In the case of retrial, according to the judicial statistical classification standard, the number of contract disputes is the most; the number of cases returned for the whole year is divided into four quarters analysis, found in the second quarter and the fourth quarter of the increase in the number. These retrial cases sent back by Hebi Intermediate people's Court are different from the characteristics of other courts, and have their unique reasons, which are related to "innate", and influenced by the judicial examination system and the trial management system of the main province in China. Basically maintain a high rate of return to review, derived from a lot of problems.
