【摘要】：裁判要旨是指導(dǎo)性案例的重要組成部分，是對指導(dǎo)性案例的抽象和概括。裁判要旨效用的發(fā)揮直接影響著指導(dǎo)性案例本身在司法實(shí)踐中作用的發(fā)揮。但是由于許多原因，導(dǎo)致人們長久以來對裁判要旨重視不夠，以致其功能得不到有效的發(fā)揮�；诖�，本文從裁判要旨的內(nèi)涵出發(fā)，通過比較的視角參考我國古代和域外的裁判要旨制度，，針對我國裁判要旨編寫的現(xiàn)狀，指出當(dāng)前存在的問題，并提出相關(guān)的完善建議。具體而言，包括以下幾個部分： 第一章是對裁判要旨的內(nèi)涵進(jìn)行一個全面準(zhǔn)確的概括，并將其定義為“將判決理由予以概括、抽象、并體現(xiàn)裁判規(guī)則精神的、以利于指導(dǎo)其他判決的、位于公報案例判決之前的典型性案例的有機(jī)組成形式”。然后對裁判要旨的功能進(jìn)行了分析。 第二章是考察了我國古代裁判要旨的發(fā)展過程和特點(diǎn)，同時也介紹了域外的同屬大陸法系的日本和英美法系的美國的裁判要旨制度，并對它們的定義、效力、構(gòu)成要素進(jìn)行了分析，由此提出可供我國裁判要旨借鑒之處。 第三章則對我國目前裁判要旨編寫現(xiàn)狀和存在的問題進(jìn)行了梳理，然后有針對性的提出了包括形式方面和內(nèi)容方面完善的建議。
[Abstract]:Refereeing gist is an important part of instructive cases, and it is the abstract and summary of instructive cases. The exertion of the umpire's purport effect directly affects the function of the guiding case itself in the judicial practice. However, due to many reasons, people have not paid enough attention to the umpire for a long time, so its function can not be played effectively. Based on this, this paper starts from the connotation of the refereeing gist, referring to the ancient and extra-territorial adjudicatory gist system of our country from the perspective of comparison, pointing out the existing problems and putting forward the relevant consummation suggestions in view of the present situation of our country's umpire gist. Specifically, it includes the following parts: the first chapter is a comprehensive and accurate summary of the connotation of the referee's gist, and defines it as "generalizing, abstracting, and embodying the spirit of the adjudication rules". Forms of organic composition of typical cases prior to the judgment of the Bulletin case, which are conducive to guiding other decisions. " Then the function of the referee's gist is analyzed. The second chapter is to investigate the development process and characteristics of the ancient adjudicative tenor of our country. At the same time, it also introduces the extraterritorial judicial gist system of Japan, which belongs to the same civil law system, and the United States, which belongs to the Anglo-American legal system, and their definitions and effects. The constituent elements are analyzed, which can be used for reference by our country's refereeing gist. The third chapter combs the present situation and existing problems of our country's referee gist, and then puts forward some suggestions including form and content.
