【摘要】：當律師發(fā)展成為一種職業(yè)群體,律師行業(yè)的管理模式就需要與時俱進的加以改革,需要不斷完善。我國目前對律師行業(yè)的管理模式主要就是司法行政部門的行政管理和律師協(xié)會的行業(yè)管理相結(jié)合的管理模式,簡稱“兩結(jié)合”的管理模式。隨著市場經(jīng)濟的發(fā)展,法制社會建設(shè)進程的需求,從事律師職業(yè)的法律工作者日益增多,這種“兩結(jié)合”的管理模式已經(jīng)滿足不了龐大的律師職業(yè)隊伍的需求,尋求律師管理體制改革日益緊迫。我國律師管理體制的改革趨勢是擴大律師協(xié)會的自治范圍,這一過程實質(zhì)上就是賦予律師協(xié)會更多的管理權(quán)利,由司法行政機關(guān)的管理逐步過渡到律師協(xié)會的自治管理。那么,律師協(xié)會自治就是由律師組成的律師協(xié)會對律師自身事務(wù)進行的自我管理、自我服務(wù)。律師協(xié)會自治權(quán)的來源主要是基于憲法學(xué)、行政法學(xué)等理論依據(jù)產(chǎn)生,其自治的內(nèi)容主要包括制定行業(yè)規(guī)范、審查行業(yè)資格和維持行業(yè)紀律等方面。律師制度的建設(shè)是現(xiàn)代國家法治建設(shè)的重要組成部分,而律師協(xié)會自治則是律師制度建設(shè)的核心要素。我國目前律師協(xié)會自治的過程中還存在尚需完善之處,如律師協(xié)會機構(gòu)設(shè)置不健全、律師協(xié)會運行機制不完善、律師協(xié)會救濟機制不科學(xué)等。針對這些問題,本文將逐一作出具體分析,根據(jù)我國新律師法的規(guī)定,借鑒國外律師協(xié)會自治的先進經(jīng)驗,克服我國律師協(xié)會自治過程中的不足。建構(gòu)一套完善而又科學(xué)的律師協(xié)會自治機制是我國律師協(xié)會自治有效運行的切實保障,也是促進律師管理體制改革的實際需要,更是法治社會中律師制度建設(shè)的核心所在。
[Abstract]:When lawyers develop into a professional group, the management mode of lawyer industry needs to be reformed with the times and constantly improved. At present, the management mode of the lawyer profession in our country is mainly the administrative management of the judicial administration department and the profession management of the bar association, which is referred to as the management mode of "two combinations". With the development of the market economy and the demand of the construction process of the legal society, the number of legal workers engaged in the lawyer profession is increasing day by day. This kind of "two combination" management mode can no longer meet the needs of the huge lawyers' professional team. It is increasingly urgent to seek the reform of lawyer management system. The reform trend of the lawyer management system in China is to expand the autonomous scope of the Bar Association. In essence, this process is to give the Bar Association more management rights and gradually transition from the management of the judicial administrative organ to the autonomous management of the Bar Association. Therefore, the autonomy of the Bar Association is the self-management and self-service of the lawyer's own affairs. The source of the autonomy of the Bar Association is mainly based on the theoretical basis of constitutional jurisprudence and administrative jurisprudence. The content of the autonomy mainly includes the establishment of industry norms, the examination of industry qualifications and the maintenance of trade discipline. The construction of the lawyer system is an important part of the construction of the rule of law in modern countries, and the autonomy of the bar association is the core element of the construction of the lawyer system. At present, there are still some problems in the process of the autonomy of the Bar Association in China, such as the imperfect establishment of the Bar Association, the imperfect operating mechanism of the Bar Association, the unscientific relief mechanism of the Bar Association, and so on. In view of these problems, this article will make concrete analysis one by one, according to the stipulation of our country new lawyer law, draw lessons from the advanced experience of foreign lawyers association autonomy, overcome the insufficiency in the process of our country bar association autonomy. Constructing a set of perfect and scientific self-governing mechanism of lawyers' association is not only the practical guarantee for the effective operation of our lawyers' association, but also the practical need to promote the reform of lawyer's management system, and the core of the construction of lawyer's system in the society of rule of law.
