【摘要】：道德是指在一定社會范圍內(nèi),其社會成員基于一定的正確的價值取向和活動方式而形成的關(guān)于在社會生活與交往中所遵循的準(zhǔn)則與規(guī)范的總和。任何職業(yè)都有符合自己職業(yè)特征的職業(yè)道德。法官作為一種特殊的職業(yè),擔(dān)負(fù)著裁判案件,維護社會公平正義的使命,其職業(yè)道德對于整個社會而言具有極其重要的作用。當(dāng)前我國處于巨大的社會經(jīng)濟變革時期,各種不同思想不斷涌入我國,各種新的社會經(jīng)濟現(xiàn)象不斷出現(xiàn),從而在道德層面上對我國當(dāng)前社會道德傳統(tǒng)和道德觀念產(chǎn)生了巨大的沖擊,在法官職業(yè)道德方面則表現(xiàn)為法官道德失范現(xiàn)象屢屢出現(xiàn),如執(zhí)法不公、徇私枉法和法官貪腐問題。究其原因,一方面是我國當(dāng)前法官職業(yè)中,確實存在一部分人素質(zhì)較低；而另一方面,則是我國法官職業(yè)道德規(guī)范的滯后；同時,對于法官職業(yè)道德的認(rèn)識還不足,沒有引起足夠的重視�；谝陨戏治�,本文認(rèn)為,需要從增強法官職業(yè)道德意識和完善法官職業(yè)道德規(guī)范制度兩個方面來加強法官職業(yè)道德建設(shè)。 本文共分為三個部分： 第一部分論述了法官職業(yè)道德的內(nèi)涵和特征；第二部分對我國當(dāng)前法官職業(yè)道德失范的現(xiàn)象做出歸納,分為公正司法、廉潔司法、為民司法、法官形象等四個部分共十六個方面的職業(yè)道德失范現(xiàn)象。并根局法官職業(yè)道德規(guī)范和實踐來分析這種失范現(xiàn)象出現(xiàn)的原因；第三部分對我國當(dāng)前法官職業(yè)道德建設(shè)的基本途徑進行思考,主要從增強法官職業(yè)道德修養(yǎng)和完善法官職業(yè)道德規(guī)范制度兩個方面論證了我國法官職業(yè)道德建設(shè)的途徑。
[Abstract]:Morality refers to the sum of the norms and norms followed in social life and communication, which are formed by the members of the society based on the correct value orientation and the way of activities within a certain social scope. Any profession has its own professional ethics. As a special profession, judges shoulder the mission of judging cases and safeguarding social fairness and justice, and their professional ethics play an extremely important role in the whole society. At present, our country is in a period of tremendous social and economic change. Various different ideas are constantly pouring into our country, and various new social and economic phenomena are constantly emerging. Therefore, on the moral level, it has a great impact on the current social moral tradition and moral concept of our country. In terms of judges' professional ethics, the phenomenon of judges' moral anomie frequently appears, such as unfair law enforcement, favoritism and corruption of judges. The reason is that, on the one hand, there is a low quality of some people in our country's current judge profession; on the other hand, there is a lag in the professional ethics of judges in our country; at the same time, the understanding of judges' professional ethics is still insufficient. Not enough attention has been paid. Based on the above analysis, this paper argues that it is necessary to strengthen the construction of judges' professional ethics from two aspects: strengthening the sense of professional ethics of judges and perfecting the system of professional ethics of judges. This paper is divided into three parts: the first part discusses the connotation and characteristics of the professional ethics of judges, the second part summarizes the phenomenon of the professional ethics of judges in our country, which is divided into just administration of justice, honest administration of justice, and justice for the people. Judge image and other four parts altogether 16 aspects of professional ethics anomie phenomenon. The third part is about the basic ways of the construction of judges' professional ethics in our country. This paper demonstrates the ways of building the professional ethics of judges in our country from two aspects: strengthening the professional ethics of judges and perfecting the system of professional ethics of judges.
