【摘要】：檢察機(jī)關(guān)作為我國(guó)專門的法律監(jiān)督機(jī)關(guān),職務(wù)犯罪偵查權(quán)是檢察機(jī)關(guān)法律監(jiān)督權(quán)的重要組成部分,在維護(hù)國(guó)家法律的統(tǒng)一正確實(shí)施,懲治和預(yù)防腐敗中起著重要作用。但隨著我國(guó)經(jīng)濟(jì)社會(huì)的不斷發(fā)展,現(xiàn)行的職務(wù)犯罪偵查機(jī)制已不能適應(yīng)新形勢(shì)下查辦職務(wù)犯罪的需要,改革和完善我國(guó)檢察機(jī)關(guān)的偵查權(quán),就成為我國(guó)司法改革中應(yīng)當(dāng)著力解決的一個(gè)重大現(xiàn)實(shí)問題。 近年來,法學(xué)理論界對(duì)職務(wù)犯罪偵查權(quán)進(jìn)行了很多研究,也提出了許多建設(shè)性的意見,并構(gòu)建了職務(wù)犯罪偵查機(jī)制的科學(xué)框架。但總的來說,經(jīng)驗(yàn)型的總結(jié)比較多,理論上還需要進(jìn)一步的研究。筆者對(duì)前階段的理論成果和實(shí)務(wù)界執(zhí)行職務(wù)犯罪偵查情況進(jìn)行了思考,試著結(jié)合我國(guó)現(xiàn)階段的具體情況從理論上提出解決制約職務(wù)犯罪偵查的有效解決辦法。 本文首先研究了職務(wù)犯罪的概念和職務(wù)犯罪偵查的相關(guān)內(nèi)涵、特點(diǎn)。其次對(duì)我國(guó)目前職務(wù)犯罪偵查體制存在的問題進(jìn)行系統(tǒng)分析,包括我國(guó)目前職務(wù)犯罪偵查體制的現(xiàn)狀和出現(xiàn)的問題。再次提出職務(wù)犯罪偵查一體化機(jī)制,并分析了構(gòu)建職務(wù)犯罪一體工作機(jī)制的目的、重點(diǎn)和原則。最后筆者提出了職務(wù)犯罪偵查一體化機(jī)制的構(gòu)建設(shè)想,主要從偵查體制、案件線索管理、偵查指揮和偵查協(xié)作四個(gè)方面建立和完善職務(wù)犯罪偵查一體化機(jī)制。 本文針對(duì)我國(guó)檢察機(jī)關(guān)職務(wù)犯罪偵查工作的現(xiàn)狀,從加大反腐敗工作力度的需要出發(fā),提出了構(gòu)建職務(wù)犯罪偵查一體化機(jī)制的建議。既具有一定理論價(jià)值,也為檢察機(jī)關(guān)職務(wù)犯罪偵查工作實(shí)務(wù)提供了可供參考的意見。
[Abstract]:As a special legal supervision organ in our country, procuratorial organ is an important part of procuratorial organ's legal supervision power, which plays an important role in maintaining the unified and correct implementation of national law, punishing and preventing corruption. However, with the continuous development of our country's economy and society, the current investigation mechanism of job-related crimes can no longer meet the needs of investigating and handling job-related crimes under the new situation, and reform and improve the investigation power of procuratorial organs in our country. It has become a major practical problem that should be solved in the judicial reform of our country. In recent years, the legal theory circle has carried on a lot of research to the duty crime investigation power, also has proposed many constructive opinions, and has constructed the scientific frame of the duty crime investigation mechanism. But in general, experience-based summary is more, the theory still needs further research. The author thinks about the theoretical achievement of the former stage and the investigation of the duty crime in the practical circles, and tries to put forward the effective solution to restrict the investigation of the duty crime according to the concrete situation of our country at the present stage. This paper first studies the concept of duty crime and the related connotation and characteristics of duty crime investigation. Secondly, the problems existing in the investigation system of duty crime in our country are systematically analyzed, including the present situation and problems of the investigation system of duty crime in our country. This paper puts forward the integrated mechanism of duty crime investigation, and analyzes the purpose, emphasis and principle of constructing the working mechanism of duty crime. Finally, the author puts forward a tentative plan for the construction of an integrated mechanism for the investigation of job-related crimes, mainly from four aspects: the investigation system, the case clue management, the investigation command and the investigation cooperation, and the establishment and improvement of the integrated mechanism of the investigation of the duty crime. In view of the present situation of the investigation of duty crime in procuratorial organs in our country, this paper puts forward some suggestions for constructing the integrated mechanism of investigation of duty crime from the needs of strengthening the anti-corruption work. It not only has certain theoretical value, but also provides reference for procuratorial organ's duty crime investigation practice.
