【摘要】：《海峽兩岸共同打擊犯罪及司法互助協(xié)議》順應(yīng)兩岸交往合作的現(xiàn)實(shí)和司法互助的需求,在兩岸司法主管部門之間建立了直接、正式以及制度化的業(yè)務(wù)合作關(guān)系。協(xié)議簽署后,對兩岸治安防范機(jī)制的對接,尤其是對于兩岸在打擊犯罪領(lǐng)域內(nèi)的合作,將起到重要的推動(dòng)作用。展望兩岸合作打擊犯罪的前景,一個(gè)制度化保障、機(jī)制化運(yùn)行、常態(tài)化交流的兩岸合作打擊犯罪框架,必將引領(lǐng)兩岸刑事司法協(xié)助進(jìn)入更廣闊的領(lǐng)域。通過成立專門機(jī)構(gòu),建立定期會(huì)晤機(jī)制,常態(tài)化開展人員交流和培訓(xùn),交流法律、法規(guī)信息,適時(shí)開展重點(diǎn)領(lǐng)域的聯(lián)合行動(dòng),建立犯罪情報(bào)信息共享機(jī)制,采取互助調(diào)查取證及追逃措施,加強(qiáng)反恐合作,不斷豐富合作形式,深化合作內(nèi)容,提高兩岸合作打擊犯罪的辦案效率,最終實(shí)現(xiàn)雙贏。 《海峽兩岸共同打擊犯罪及司法互助協(xié)議》正式簽署后,在具體執(zhí)行的層面上出現(xiàn)了一系列難點(diǎn)和障礙,如何發(fā)揮協(xié)議的正面價(jià)值,避免發(fā)生過大的執(zhí)行障礙是擺在兩岸相互合作面前的重要課題。論文就如何進(jìn)一步完善協(xié)議的執(zhí)行體制、加強(qiáng)兩岸之間的合作交流、共同打擊犯罪等問題進(jìn)行了分析研究,并提出了自己的見解。論文對近期頻繁發(fā)生的電信詐騙案件予以高度的關(guān)注,希望通過此類犯罪的防范和監(jiān)控進(jìn)一步提高兩岸間的合作效率。
[Abstract]:The Agreement on Joint Action against Crime and Mutual legal Assistance between the two sides of the Taiwan Strait conforms to the reality of cross-strait exchanges and cooperation and the needs of mutual legal assistance, and has established direct, formal, and institutionalized business cooperation relations between the judicial authorities on both sides of the strait. After the signing of the agreement, it will play an important role in promoting cross-strait security prevention mechanism, especially the cooperation between the two sides in the field of combating crime. Looking forward to the prospect of cross-strait cooperation in cracking down on crime, a framework of cross-strait cooperation to combat crime with institutionalized guarantee, institutionalized operation, and regular exchange will surely lead to a broader field of criminal judicial assistance between the two sides of the strait. Through the establishment of specialized agencies, the establishment of mechanisms for regular meetings, the normalization of personnel exchanges and training, the exchange of information on laws and regulations, the timely development of joint operations in key areas, and the establishment of mechanisms for the sharing of criminal intelligence information, To take measures of mutual assistance, investigation, evidence collection and pursuit, strengthen anti-terrorist cooperation, constantly enrich the forms of cooperation, deepen the contents of cooperation, and improve the efficiency of cross-strait cooperation in the handling of criminal cases. After the signing of the "Agreement on Joint Action against Crime and Mutual legal Assistance between the two sides of the Taiwan Strait", a series of difficulties and obstacles have emerged at the level of concrete implementation, and how to give full play to the positive value of the agreement, Avoiding excessive implementation obstacles is an important issue in front of cross-straits cooperation. This paper analyzes and studies how to further improve the implementation system of the agreement, strengthens the cooperation and exchange between the two sides of the strait, and jointly combat crime, and puts forward its own views. The paper pays close attention to the recent frequent telecom fraud cases and hopes to further improve the efficiency of cross-strait cooperation through the prevention and monitoring of such crimes.
