【摘要】：在中國,調(diào)解制度有著悠久的歷史,在不同的歷史時期,調(diào)解制度在定紛止?fàn)幒途S護社會穩(wěn)定上都發(fā)揮的巨大了作用。回顧我國當(dāng)代的法院調(diào)解制度,其遵循了“馬鞍形”的軌跡,即從“調(diào)解為主”到“著重調(diào)解”到“自愿與合法調(diào)解”,再到現(xiàn)在的“調(diào)解優(yōu)先、調(diào)判結(jié)合和大調(diào)解的多元化糾紛解決機制。 從昨天的調(diào)解發(fā)展到今天的“大調(diào)解”,調(diào)解制度的功能得到了更加充分的發(fā)揮,且備受世人矚目。但是,從目前我國的大調(diào)解制度發(fā)展趨勢來看,則具有“運動性”的特點,無論是在立法和制度構(gòu)建方面,還是在軟硬件的投入方面都有諸多不如人意之處,甚至在某些方面還存在著嚴(yán)重的不足。 本論文全文約四萬字,分為四個部分。 第一部分對調(diào)解和大調(diào)解的概念進行了界定,探討了大調(diào)解的特征,并且以江蘇省南通市為例分析了大調(diào)解的結(jié)構(gòu)框架及運行程序 第二部分結(jié)合我國的實際,著重分析了我國當(dāng)前構(gòu)建大調(diào)解制度的必要性和可行性。 第三部對近幾年來我國部分地區(qū)大調(diào)解制度的運行情況作了考察和評價。 第四部分是本論文的重點,作者對構(gòu)建我國大調(diào)解制度從七個方面提出了具體的建議。
[Abstract]:In China, mediation system has a long history. In different historical periods, mediation system plays a great role in settling disputes and maintaining social stability. Recalling the contemporary court mediation system in China, which follows the path of "saddle shape", that is, from "mediation as the priority" to "focusing on mediation" to "voluntary and legal mediation", and then to the present "mediation first", The diversification dispute settlement mechanism of the combination of mediation and mediation. From yesterday's mediation to today's "Great Mediation", the function of mediation system has been brought into full play and attracted worldwide attention. However, judging from the development trend of the great mediation system in our country at present, it has the characteristics of "mobility". Whether in legislation and system construction or in the investment of software and hardware, there are many unsatisfactory points. Even in some areas there are serious deficiencies. This thesis is about 40,000 words, divided into four parts. The first part defines the concept of mediation and great mediation, probes into the characteristics of great mediation, and takes Nantong city of Jiangsu province as an example to analyze the structural framework and operation procedure of great mediation. The second part combines the reality of our country. The necessity and feasibility of constructing the great mediation system in our country are analyzed emphatically. The third part investigates and evaluates the operation of the mediation system in some regions of China in recent years. The fourth part is the emphases of this thesis, the author puts forward concrete suggestions from seven aspects to construct our country's great mediation system.
