【摘要】：保護服刑人員人權(quán)是監(jiān)獄工作法制化的必然要求,是豐富依法治國內(nèi)涵、提升社會主義法制理念、應(yīng)對國際人權(quán)斗爭的客觀需要。 目前,我國在服刑人員人權(quán)保障方面做了很多工作。但不可否認,在服刑人員人權(quán)保障問題上還存在一些不容忽視的問題,有的問題甚至還很嚴重。認真研究、分析我國監(jiān)獄服刑人員人權(quán)保障方面存在的問題,制定相應(yīng)對策,對于提升我國監(jiān)獄服刑人員人權(quán)保障的質(zhì)量與水平,在政治上和監(jiān)獄建設(shè)的實踐中具有十分重要的理論價值和實踐意義。 人權(quán)是法治國家下公民的一項基本權(quán)利,服刑人員人權(quán)則是公民權(quán)利的一項特殊內(nèi)容,是公民權(quán)利在特定條件下形成的一種特殊表現(xiàn)形式及表達方式。保護服刑人員人權(quán)不僅符合當今世界的行刑趨勢,有利于降低刑罰的負面影響,實現(xiàn)刑罰目的,而且更有利于提高監(jiān)獄人民警察嚴格執(zhí)法、依法辦事的自覺性,樹立我國監(jiān)獄的良好形象。 在我國現(xiàn)有的法律體系中,對服刑人員的人權(quán)保障已經(jīng)有一定的規(guī)定,但是隨著社會的發(fā)展,人們對人權(quán)的保護意識的增強,對服刑人員人權(quán)的保障也得到了更多的關(guān)注。本文中,筆者通過分析服刑人員的人權(quán)保障范圍的現(xiàn)狀、制約人權(quán)保障范圍的因素,提出了相應(yīng)的對策,并建議建立更加完善的服刑人員人權(quán)保障體系需要從一下五個方面進行改革,即健全監(jiān)獄法律體系、完善監(jiān)獄監(jiān)督體制、改革監(jiān)獄管理體制、加強對監(jiān)獄民警的人權(quán)意識教育、將涉及監(jiān)獄罪犯權(quán)利的各項制度逐條落到實處、成立國際人權(quán)公約與刑罰執(zhí)行委員會,以期達到完善服刑人員人權(quán)保障體系的目的。
[Abstract]:The protection of the human rights of prisoners is the inevitable requirement of the legalization of prison work. It is also an objective need to enrich the connotation of governing the country by law, to promote the socialist legal system and to meet the objective needs of the international human rights struggle. At present, our country has done a lot of work in protecting the human rights of prisoners. But it is undeniable that there are still some problems which can not be ignored in the protection of the human rights of prisoners, and some problems are even very serious. To study and analyze the problems existing in the protection of the human rights of prison inmates in our country, and to formulate corresponding countermeasures to improve the quality and level of the human rights guarantee of prison personnel in China. It has very important theoretical value and practical significance in politics and practice of prison construction. Human rights is a basic right of citizens under the rule of law, and the human rights of prisoners is a special content of civil rights. It is a special form of expression and expression of civil rights under specific conditions. The protection of the human rights of prisoners is not only in line with the trend of execution in the world today, but also conducive to reducing the negative impact of punishment and achieving the purpose of punishment. It is also conducive to enhancing the awareness of the prison people's police to strictly enforce the law and act in accordance with the law. Set up a good image of China's prisons. In the current legal system of our country, the human rights protection of prisoners has been stipulated to some extent, but with the development of society, people's awareness of the protection of human rights has been strengthened, and the protection of the human rights of prisoners has been paid more attention. In this paper, the author analyzes the current situation of the human rights protection scope of the prisoners and the factors that restrict the human rights protection scope, and puts forward the corresponding countermeasures. It is suggested that the establishment of a more perfect human rights guarantee system for prisoners should be reformed from the following five aspects: perfecting the prison legal system, perfecting the prison supervision system, reforming the prison management system, and strengthening the human rights awareness education of the prison police. In order to perfect the human rights guarantee system of prisoners, the system concerning the rights of prison criminals should be put into practice article by article, and the international human rights convention and the penalty executive committee should be set up in order to perfect the system of protecting the human rights of prisoners.
