我國民事裁判文書上網(wǎng)研究

【摘要】:裁判文書上網(wǎng)公開制度屬于審判公開原則的重要體現(xiàn),在司法實(shí)踐中帶來一系列積極的影響,一方面,有利于各級(jí)法院落實(shí)公開審判原則、全面接受群眾的監(jiān)督,另一方面,也能促進(jìn)公民基本權(quán)利的保障,如參與權(quán)、知情權(quán)和監(jiān)督權(quán)等。2012年出臺(tái)的新《民事訴訟法》第156條明確規(guī)定公眾有權(quán)利查閱已經(jīng)生效的判決書以及裁定書。2016年10月1日起施行的《最高人民法院關(guān)于人民法院在互聯(lián)網(wǎng)公布裁判文書的規(guī)定》進(jìn)一步明確了民事裁判文書上網(wǎng)公開制度的內(nèi)容、程序及相關(guān)保障措施,借助中國裁判文書網(wǎng)等平臺(tái),各級(jí)法院生效并公開的裁判文書具有統(tǒng)一的公開平臺(tái)、公開程序、公開內(nèi)容、公開保障措施,從而推動(dòng)實(shí)現(xiàn)司法透明化的發(fā)展。與域外發(fā)達(dá)國家(地區(qū))的民事裁判文書上網(wǎng)公開制度相比,我國在裁判文書質(zhì)量、審核程序、檢索程序、技術(shù)處理等方面依然存在一些隱患,這些不足將在一定程度上阻礙審判公開事業(yè)的發(fā)展,引起了我們的深思。通過對(duì)案例予以借鑒,各地審判機(jī)關(guān)可以明確統(tǒng)一的裁判標(biāo)準(zhǔn)。民事裁判文書上網(wǎng)制度可以有力地維護(hù)司法公正,滿足公民知情權(quán)的需求,從而提升司法公信力。可以說,民事裁判文書上網(wǎng)是司法公開的重要方式,也是審判公開制度的主要內(nèi)容,F(xiàn)階段,裁判文書上網(wǎng)公開工作作為司法改革的重要內(nèi)容,應(yīng)當(dāng)進(jìn)一步加大執(zhí)行力度。然而,當(dāng)前我國的司法實(shí)踐中,裁判文書上網(wǎng)公開制度依然存在一系列問題,如裁判文書質(zhì)量不高,生效的裁判文書發(fā)布不及時(shí)等。導(dǎo)致這些問題出現(xiàn)的原因包括:確保裁判文書質(zhì)量的保障機(jī)制尚未建成;裁判文書制作者的業(yè)務(wù)能力有限等等。完善裁判文書公開上網(wǎng)制度,應(yīng)以立法的方式明確裁判文書上網(wǎng)公開的統(tǒng)一標(biāo)準(zhǔn);處理好當(dāng)事人以及其他訴訟參與人的個(gè)人信息保護(hù)問題,適當(dāng)?shù)馁x予當(dāng)事人選擇是否公開的權(quán)利,遵循可分割原則;通過提高法官的綜合素質(zhì)、塑造內(nèi)心正義價(jià)值、增強(qiáng)對(duì)法律方法的運(yùn)用能力,從而更好的完成裁判文書的制作工作,提現(xiàn)出裁判文書的公正性,使社會(huì)公眾對(duì)司法機(jī)關(guān)更加信服;實(shí)行激勵(lì)機(jī)制和獎(jiǎng)懲機(jī)制,逐步提高公開裁判文書的質(zhì)量;最后,通過完善裁判文書查詢系統(tǒng),加大網(wǎng)絡(luò)硬件建設(shè),完善裁判文書的公開平臺(tái)。
[Abstract]:The open system of judgment documents online belongs to the important embodiment of the principle of open trial, which brings a series of positive influences in judicial practice. On the one hand, it is beneficial for courts at all levels to implement the principle of open trial and accept the supervision of the masses, on the other hand, It also promotes the guarantee of the fundamental rights of citizens, such as the right to participate, The right to know and the right to supervise etc. Article 156 of the new Civil procedure Law promulgated in 2012 clearly stipulates that the public has the right to consult the judgments that have come into force as well as the ruling. The people's Law of the Supreme people's Court came into effect on October 1, 2016. The court has further clarified the contents of the open online system of civil adjudication documents by publishing the provisions of the adjudication documents on the Internet. Procedures and related safeguards, with the help of platforms such as the China judgment documents Network, the courts at all levels have a unified open platform, open procedures, open content, and open safeguards for judicial documents that are effective and open to the public. In order to promote the development of judicial transparency. Compared with the open online system of civil adjudication documents in foreign developed countries (regions), there are still some hidden dangers in our country in terms of the quality of adjudication documents, examination procedures, retrieval procedures, technical processing, and so on. These deficiencies will hinder the development of open trial to a certain extent, causing us to ponder. By using the case for reference, the local judicial organs can clearly unify the standard of adjudication. The online system of civil judgment documents can maintain judicial justice and meet the needs of citizens' right to know, thus enhancing the judicial credibility. It can be said that the Internet of civil adjudication documents is an important way of judicial openness, and also the main content of open trial system. At present, as an important part of judicial reform, judicial documents online publicity should be further strengthened. However, in the current judicial practice of our country, there are still a series of problems in the system of online publication of adjudicative documents, such as the low quality of adjudicative documents and the untimely issuance of effective adjudicatory documents. The causes of these problems include: the guarantee mechanism to ensure the quality of adjudicative documents has not yet been established; the professional ability of the umpire producers is limited, and so on. In order to perfect the system of open Internet access of adjudicative documents, we should make clear by legislation the unified standard of online disclosure of adjudicative documents, deal well with the protection of personal information of the parties and other litigant participants, To give the parties the right to choose whether to be public or not, to follow the principle of divisibility; to improve the comprehensive quality of judges, to shape the value of inner justice, to enhance the ability to use legal methods, and thus to better complete the production of judicial documents. Show the fairness of the judicial documents, make the public more convinced of the judicial organs; implement the incentive mechanism and reward and punishment mechanism, gradually improve the quality of open adjudication documents; finally, through the improvement of the judicial documents inquiry system, Increase the construction of network hardware, improve the open platform of referee documents.
