【摘要】：本文從分析人民調(diào)解制度建構(gòu)的可行性和我國人民調(diào)解制度的歷史沿革出發(fā),剖析了人民調(diào)解制度的概念和當(dāng)前面臨的問題和不足,并進一步分析了ADR替代性糾紛解決方案,通過對吉林省人民調(diào)解制度的實踐經(jīng)驗總結(jié),提出了新時期人民調(diào)解制度建構(gòu)的設(shè)想,以期能對新時期人民調(diào)解制度的建構(gòu)有所助益。 建設(shè)和諧、穩(wěn)定的社會主義法治國家是黨和國家提出的發(fā)展目標(biāo),也是全社會的共同期待。本文從理論出發(fā),結(jié)合吉林省人民調(diào)解工作實踐經(jīng)驗,提出新時期的人民調(diào)解制度建構(gòu)應(yīng)適應(yīng)新的社會結(jié)構(gòu)、利益、矛盾的變化,認(rèn)識和把握新形勢下和諧社會建設(shè)的特點、規(guī)律和發(fā)展趨勢,實事求是地分析法治建設(shè)與維護社會穩(wěn)定工作中存在的問題,有針對性地建立一套解決矛盾和化解沖突的長效機制。
[Abstract]:Based on the analysis of the feasibility of the construction of the people ' s mediation system and the historical evolution of the people ' s mediation system in China , this paper analyzes the concept of the people ' s mediation system and the problems and shortcomings , and further analyzes ADR alternative dispute solution . Through summing up the practice experience of the people ' s mediation system in Jilin Province , this paper puts forward the idea of the construction of the people ' s mediation system in the new period , hoping to help the construction of the people ' s mediation system in the new period .

On the basis of theory , this paper puts forward that the construction of the people ' s mediation system in the new period should adapt to the new social structure , interests and contradictory changes , understand and grasp the characteristics , laws and development trend of the construction of the harmonious society in the new situation , analyze the problems existing in the construction of the rule of law and maintain the social stability , and set up a long - term mechanism to solve the conflict and resolve the conflict .
