【摘要】：當(dāng)前我國社會(huì)矛盾糾紛不斷增加的主要原因是公權(quán)力行使不規(guī)范,表現(xiàn)為社會(huì)政策和法律制度滯后、政府違法決策處置突發(fā)事件不當(dāng)、行政執(zhí)法不規(guī)范、法律實(shí)施不良、行政不作為、信息不公開等,預(yù)防化解社會(huì)矛盾糾紛的根本出路在于規(guī)范公權(quán)力行使,包括明確權(quán)力邊界,規(guī)范立法權(quán)力,健全程序規(guī)則,規(guī)范決策和執(zhí)法行為。由于解決矛盾糾紛主要依賴行政方式,訴訟、復(fù)議等法定救濟(jì)渠道并未充分發(fā)揮作用,致使社會(huì)矛盾越解決越多,預(yù)防化解矛盾糾紛的難度不斷加大。為此,應(yīng)當(dāng)慎用行政手段,暢通法定救濟(jì)渠道,有效化解社會(huì)矛盾糾紛。
[Abstract]:At present, the main reasons for the increasing social contradictions and disputes in our country are the non-standard exercise of public power, the lagging of social policy and legal system, the improper handling of unexpected incidents by the government in violation of the law, the non-standard administration of law enforcement, and the bad implementation of the law. The basic way to prevent and resolve social contradictions and disputes lies in standardizing the exercise of public power, including defining the power boundary, standardizing legislative power, perfecting procedural rules, and standardizing decision-making and law enforcement. Because the solution of contradictions and disputes mainly depends on the administrative way, litigation, reconsideration and other legal relief channels do not play a full role, resulting in more and more social contradictions resolved, and the difficulty of preventing and resolving contradictions and disputes is increasing. Therefore, administrative means should be carefully used, legal relief channels should be unblocked, and social contradictions and disputes should be effectively resolved.
