【摘要】：隨著社會(huì)不斷發(fā)展,法律規(guī)范日趨完善,司法公正卻面臨著現(xiàn)實(shí)困境。法官腐敗屢見(jiàn)不鮮,特別是群體性、團(tuán)伙性的法官集體腐敗案正成為法官職務(wù)犯罪的突出特征。這一現(xiàn)象既折射出司法制度的不完善,也折射出法官道德自律的缺失。規(guī)制法官司法腐敗離不開(kāi)司法制度倫理與法官品性的德性倫理這兩個(gè)維度,即整體的司法制度規(guī)范維度與法官的司法道德自覺(jué)維度。這兩個(gè)維度體現(xiàn)了法官活動(dòng)的本體性與價(jià)值性的統(tǒng)一、外在性與內(nèi)在性的統(tǒng)一、客觀性與主觀性的統(tǒng)一。司法制度倫理優(yōu)先于法官品性的德性倫理,法官品性的德性倫理高于司法制度倫理,司法制度倫理與法官品性的德性倫理相互轉(zhuǎn)化,二者相互契合有助于促進(jìn)司法公正的實(shí)現(xiàn)。
[Abstract]:With the development of the society , the legal norm is gradually perfected , and the judicial justice is confronted with the realistic predicament . The corruption of the judge is not only the imperfection of the judicial system , but also the lack of the moral self - discipline of the judge . The two dimensions reflect the unification of the body and value of the judge ' s activities , the unity of the external and the internal , the moral ethics of the judge ' s character , the mutual transformation between the ethics of the judicial system and the moral ethics of the judge ' s character , and the mutual agreement helps to promote the realization of judicial justice .
